I got a phone call yesterday from the general secretary of the POA,i wrote to him and told him what was going on and to give him his due he said this is happening far too much,the prison service are by passing medical retirement and going for inefficiency.
This must have upset my rep and he told me he has 320 members to worry about,i told him that may be so.....but only ONE is out of a job!
He said ''i don't get paid for doing this'' again i said this may be true but now and again you are required TO PULL YOUR FINGER OUT AND DO A BIT instead of reading newspapers all day.
As usual i will keep you all informed

Hi Mark.
Your Rep is just feeling a bit miffed because as he sees it, you have went behind his back. We all know why you did it, I probably would have too, but reps don't like you going elsewhere for help. I had a guy in my team almost out the door, Rep A was helping him. One day he asks Rep B his opinion. That was it, Rep A refused to represent him as felt he was blabbing all over the place and going behind his back.
They are funny like that sometimes. But you do whatever it takes. You will win, you have the determination to.0 -
Sometimes Alex people need ....encouraging,i won't get my job back but you know what it might save someone else s.....you and i are fighters i might be out but i'm not down.
Its not my fault i have time on my hands is it!0 -

Nope you are right. So many people ask me Why??? about my negligence claim, 'is it money?' 'it won't change the way you are' blah blah. They just don't get the fact that someone DID this to me through no fault of my own and they have to pay for it, plus if it stops it happening to one other person then in my mind that's worth any compo they can throw at me. Fight on I say :x , that's my angry fighting face.0 -

A quick update....CAPITA (prison service medical advisors) have made me an appointment on 5 Nov,apparently i should have seen them before the capability hearing to dismiss me on 8 Sept! they think i am still employed which technically i suppose i am!
Things are progressing with the tribunerals and i am still undergoing treatment so there was no need for me to have lost my job,i look forward to my appeal on 15 Dec.!
I hope things should work out well and will keep you posted. :!:0 -

They're asking me now if i want to cancel my appeal against dismissal any advice what to do? :roll:0 -

I guess you would withdraw your appeal against dismissal as youre going on ill health retirement.
But i am no legal person so suggest you get your union legal dept to advise you.

I know what you mean - justice.
Is it possible to make a compo claim for stress although i believe these are hard to win and also have early retirment through health i dont know..............i would try to research this throughly, why should they get off easily..............or could you put in a grievance so at least you feel you have got them some way?0 -
Does anyone out there have any experience of medical retirement under the civil service pension scheme?(premium scheme,lower tier) i am having no luck with gathering any information.

Phone your pension administrator who should post out the info to you or try the website.0 -

A bit of a development,i have been asked to attend a meeting to discuss my medical retirement by the governor on 2 Dec (the same one who finished me on inefficiency and told me to f*** off out of the establishment and never be seen in here again you may remember?).I hope we will be talking money.Iwould expect to have to drop my appeal to area against dismissal and proceed with the discrimination tribuneral instead ,unless we can wrap it all up in one go.
I am going to attend and listen carefully,i don't trust these people at all,hopefully it will be to my advantage.I need to move on and put the misery of it all behind me.Remember if you are thinking of going into the prison service be a prisoner!!0 -

Have a union rep with you.
What ever they ask, say you will either think about it or take advice. By saying this you can check your options and it will make them sweat...........remember this person and what they were like to you the first place, they werent nice and if they are nicey nicey to get you to agree to something dont............
less talking is the best - look thoughtful like you are thinking about what he/she said not like you are clueless - not being rude here, look like you have something up your sleve.
Then afterwards write everything down before you forget,check out the facts then decide.

Uncanny......this is exactly how i discussed it with my wife.I will have to keep a lid on my feelings and stay calm but boy will it be difficult.We should be discussing a section 11 which is a permenant injury benefit but i bet we don't.
I have asked for an agenda to be discussed so i will know what we will be discussing if it arrives i will let you all know.

Its hard but keep your mouth shut in the meeting!! They couldnt care less about you, they just want it sorted quick as poss to their benefit. Usually they dont know what theyre talking about and make things up and you feel pressurised. I have a sort of mantra if it doesnt feel right it probably isnt, so go with your gut feeling. Just think he is a spineless prat who loves the power.........bit strong here but i am sick to dead of these idiots!! or perhaps its the nice lager i have just had with my curry.

I have received my figures for medical retirement....quite suprised at ho good they are.Roll on Wednesday i will try to squeeze more out of the b's.

Thats me medically retired....had to drop my appeal to area though against unfair dismissal.
Got a decent settlement not nearly enough to retire on but at least i can move on to hopefully something more sedate.Govenors face was a picture...totally gutted he says he has never heard of anyone appealing against a decision not to give medical retirement and winning.I told him he should have been patient and waited until i saw the specialist.
It jost shows you what can be done if you have the will to fight the system.I hope this tale offers hope to others.If only getting rid of the pain in my knees was sortable!!!!0 -
