CAB stitch up

I applied for DLA and was refused because my consultant didnt fill the form out properly. I asked them to reconsider nd they said I have no restrictions with my walking.
I applied again getting someone from the CAB to fill the form out. I told them I cant walk more than 10 metres without severe pain before I have to stop but said DLA wouldnt believe anybody could only walk such a short distance. They asked me to ask my GP to support me in my appliation that I could walk 30-40 metres before being in pain. They said they would help me all they could. CAB said if the GP backed this up Id get DLA once and for all.
I signed the form but unknowns to me the CAB put I could walk 80 yards before posting it for me. The DLA say that although I have restrictions I can walk 30 metres and use walking aids so are not entitled. The day the decision was written they also gave me a statement of reasons. I rang the DLA and they say that should never have happened. Im supposed to request 'a statement of reasons'. What do I say to the DLA when I ask them to look again.
My O.T says it is an outrage that I dont get DLA already Ive got letters and reports of hospitals, O.T, GP but having listened to CAB I feel like Ive blown the changes. Please help. Im going to spend the day in a rehabilitation centre at the hospital falls clinic in 2 weeks which is supposed to assess my needs further.

Hi
Not up much on this. Can you appeal at all?
When you go on the rehabilitation, will they write on your behalf?
Have you been in touch with CAB and told them what they had done.
I'm sorry i'm not more help to you.
I hope you get on alright and fingers crossed for you.

oh dean
this sounds like a disaster!
i think you can appeal and if you can you must go for it (dare you consider a compliant against cab?)
there are people on this forum who know loads - joseph for one - who can advise.
me i just sympathise with you and wish you luck for the assessment - i really hope it helps.

Thanks, I thought if CAB helped me they would improve my chances of perhaps getting DLA. But now I will have to explain that I was advised not to put the complete truth and that they completed the form in full after I had signed it.
I contacted CAB and they said the woman who helped me no longer works at my local outreach centre. But does work in other locations. They said she will be so dissappointed tinfact gutted hat I have been refused. Not as much upset as I am thanks to her....
The Rehabilitation Falls Clinic at the hospital I hope will be able to support my application. Because I have to spend a full day there so they can assess me, I see an independent O.T, Consultant, Nurse and Pysiotherapist.
Many thanks for your help. Much appreciated.

Hello, I'm sorry to hear your story, I'd certainly request a meeting with a senior member of your CAB. It sounds like the person dealing with your claim was not up to the job, to put it mildly. If you could talk to someone senior, they may be able to give you the advice you need and explain what went wrong with the first claim you made. If nothing else, it would draw the attention of the senior staff to the fact that some of their advisors may need further training or taken away from dealing with the public directly.
I know none of this seems very helpful to you, but it may make you feel better and you never know, they may find someone to give you top knotch advice and win a appeal for you! I hope all goes well and gets sorted.

I have been wondeing what happened to you.
Tell them CAB made a mistake. When my autistic son was refused DLA cos school had said he didnt need any special help yet had told me a few days before that they had to explain everything to him alone in simple language(no distractions) so I phoned DLA up,told them and they wrote back to school for clarification.I n the meantime I visited school to remind them what they had previously told me and this constitutes special help.(there are other probs of course).
Son was awarded DLA.Sometimes the form fillers dont get it and you have to tell them how things are for you.
The problem is if you can walk with aids you no longer seem to get DLA.If you are still suffering with aids you need to insist this is made clear.Do you need some-one with you out-and-about?
Dean I hope the outcome is in your favour.Keep fighting.
Best wishes

Hi Dean,
I am so sorry to hear of the problems you have been having with the DLA and CAB. I agree with what Elizabeth suggests why not ring them and explain the CAB have made an error. Also can your OT help you? My O.T. completed the page on the back supporting the application. However, they still wrote again to the OT asking more questions but I managed to get DLA. Your O T is the one who probably knows your capabilities best. Dont give up, appeal against the decision.
