DLA appeal result!

Attended DLA appeal last Friday (9th April) was told I would be contacted with decision within 48 hours. Assumed they would not count Sat or Sun, so expected letter on Wed. Nothing, waited anxiously for post on Thur, nothing. I had made my mind up that they had refused the appeal, and thats that. Post this morning, a letter from the tribunals service. Opened it expecting it to say "go away, you dont need any help" or words to that effect. "The appeal was allowed" entitled to the care component at the lowest rate only with effect from 28/04/09. No mobility award. Dont know how they understand that I need care but dont need help to get out and about. But, hip hip hooray, its a result. They kept saying at the appeal that everything refers to a year ago. So disability office says I have to apply again for mobility component because my mobility has decreased since last year.
There was many times I felt like giving up but after reading the posts on this forum, I was determined to fight to the end. So Ive only won a small battle but I am still in the war. I want to say a huge THANKS to all the people who sent messages of support and encouraged me to keep fighting. Hope anyone else who is going through the same hassle takes heart from the fact that you can win.

Well done. That will be a lot of backpay owing to you. I agree with your comments on the issue of mobility, how do you need care but not with walking about. I was also wondering about your claim for mobility which was refused. If you appeal, when will you say your mobility problems started to qualify for mobility rate?If they dont think they were bad enough in April 09 (cos thats what they were assessing you on) have you lost out on the other months too because this claim took so long to sort?Or you going to make a fresh appeal from April 2010 for your mobility problems. It seems unfair if you miss out.

Congratulations Trisha, are you going to get someone to help you fill in the form for disability :?: I've heard cab are got at filling them in. Good luck with your claim.

Well done Trisha, I am really pleased for you. Like you say, that battle is won, now you can press on with the mobility component and win that one too. As the mobility will be a new claim, they can actually base things on current problems instead of historic ones, which they tend to do given half the chance. Chuffed to bits for you.
