Next Step - DLA

As you will know from my previous threads I lost all my appeals & finally the tribunal yesterday for DLA.

Of course all the witty answers to the questions asked yesterday came to me in bed last night. I am not stupid, I have run my own software testing company for the last 14 years & can hold my own but yesterday I was an indimated wreck.

I have had time to think and I want answers. Why was my report changed, why does the purpose of DLA differ in reality to what is stated on DWP website and various other questions?

I am going to spend some time gathering my info then I am going to challenge, not neccessarily an appeal to the upper tribunal but challenge & try to get answers.

I had previousl contacted my MP who wrote to DWP but couldn't help as I was waiting for a tribunal date but they will be amongst the people that I send my letter to.

    The good answers always come too late. I am glad you are going to argue against their decision: remember they are healthy morons who do not live with the daily challenges we face, and who would probably fall to pieces if they did. I wish you well. DD

    Couldn't agree more - if it was a commercial product/service being advertised and the actuality differed so much from the description then consumers would be complaining to the OFT. What you have is not to put to fine a point upon it deliberatly misleading questions which encourage exaggeration and a set of perfect answers which only the DM's are privy to.

    pop along to the dr for some hydocortisone cream and qv wash and cream or similar band.
    i get the same on my hands and wrist and sometimes my legs left untreated infection can kick in

    Hi Anne,

    Its always after you think of what you could have said but I honesty think with the new system it wouldn't matter what you said! I hope you can get some answers though and maybe the MP will be able to help you more now? Hang in there and good luck. Cris xx

    Hi Anne, I just sent in my claim form today. :( . What you've experienced doesnt fill me with any optimism. I sent in an earlier claim, (before RA diagnosis) for my osteo and mobility issues, and it's awaiting a tribunal date. When I received copy papers, they changed the distance I said I could walk without stopping from 10 metres to 50 metres. No explanation was given. No surprise you had a similar experience then :x :x :x

    I am sure that there is something called a judicial reveiw...could this help??

    If not what about the press??

    is that too much publicity for you?? Even if it was only a letter to a newspaper??

    Sorry only just catching up here to see your other post about the DLA disappointment after all that stress of the tribunal.
    Good to see you are finding the energy to fight and ask those questions that you deserve answers too after being treated so badly. Do keep at it, and let us know how it goes.

    Hi Anne,

    good for you :!: :!: what has happened to you, the stress and anxiety of going to tribunal and especially the changes made to your responses on the forms is appalling, and you're right to fight back.

    let us know Anne what you decide to do..... and use the' Consultation on Disability Benefits' (sticky at the top of the page) to feedback your negative experience to the AC campaigns group and/ or direct to the government.
