    Hi ,
How stupid is all this ??? surely the way you have used your badge is compleatly correct --- its a shame that the warden is blind , if he had watched correctly he would have seen the lady get out , fight , fight fight , infact if it comes to help its a shame that your correct understanding of the rules for using blue badges can not be supported by us , the person to whom the badge applies was present , that is all that matters , make a big fuss

    Hi everyone
Sorry been side tracked with Christmas approaching fast :)) Got a letter this morning and they have If they rejected the challenge once more. They are still standing by their traffic wardens statement and insist if you park the car without the holder in the car then its illegal and the pcn is correct. If you park the car in a disabled bay to collect the badge holder and have to leave the car this is also illegal and will result in a pnc.
We are not paying the ticket and are willing to go all the way on this one.

    Hi John&Jean,
Good for you, how utterly ridiculous it all is. Wish you all the luck in the world and hope you have a peaceful Christmas Poppy x

I know that there are rules but somehow this seems to be too ridiculous for words. I guess that parking infringements are easy to punish and make their figures look good but you have to fight this, it is daft: I am sure that all of us with BBs unwittingly break the rules occasionally, I think it unlucky that you were spotted by Mr Zealous! Good luck with the fight. DD

I cannot believe they are acting this way, how are you supposed to help a disabled person to the car..??
It's madness, good for you sticking to your guns!!!
    Best of luck with it

    Hi
I am sorry to say, I think maybe they have it in for disabled drivers, I hear so many people say we have been find for something pathetic, I think if they look hard enough then they can find something.

Sorry members my computer has been broke just saved up enough for a new one :)

After 8 months of arguing we now have threatened with bailiffs :( and must pay. Here are some stupid rules they say must be done now ( this is no joke).
The blue badge holder must be present at the time the car is parked, that means no parking in disabled bays to collect my wife.

The blue badge holder must be in the car when it is parked, sometime If I park in a tight gap and need the wheel chair our or to open the door wide for my wife i park slightly out the bay open the door wide and get my wife out, then pull back into the bay. If I do this I will get a parking ticket.

If the blue badge holder is in hospital you must, park the car in a normal bay, walk to the hospital get the blue badge holder walk them to a disability bay, leave them there, walk back to the car, and drive to that bay.

But you only dropped her off a few spaces back. I would have done the same and felt okay about it, I certainly wouldn't expect a fine. She was as good as present. can you go to court to fight this out?

    Very complicated...
We had a hire car, so we appealed once it got knocked back, we appealed again but the council demanded payment from the hire company and they paid, we never got told they were doing this.. Now we are getting sued from the hire company, to sum it all up.

So now the £30 fine is at £125+ fees :(

I think you were just very unlucky to be spotted by a zealous warden. I am sure that quite a few of us unwittingly break the rules but the chances of being spotted are very few and far between. I am sorry that the initial cost has escalated but perhaps it's best to pay up and put it all behind you. I wish you both well. DD

    HI Dream Daisy
We followed the blue book scheme rules to the letter and didnt misuse the badge. Its the principle of admitting guilt, which could lead to a £1000 fine and remove of our blue badge,The holder was present and we didn't do anything wrong so I am not paying. It does not say in any of the rule books that person had to be in the car, just present. ( this was back in November 2010 prior to the rule changes.)

So it is the hire car company demanding the payment? Did you get told when they made a payment? You must owe them the £30 only (which is what they paid) so what are the other fees for?

Have the rules changed recently or is this your councils interpretation of the rules? My OH often drops me off at the back of Boots then drives round to park in the disabled bay out the front as near to the shop as possible and waits for me to walk back to the car. If he gets out of the car he would be breaking the rules then? Or is he breaking the rules by parking without me getting out of the car in the first place?

I am sorry to say I honestly think some of the traffic wardens have it in for us, they dont like the fact that we can park in places were others cant.
Granted you could get someone saying they have drooped the disabled person off, but when they can see the person or you can prove they are with you.....the world has gone mad..

The first ticket was £30, then we appealed, that got turned down, they then demanded £70 as so many days had passed and then the hire company started to charge us £25 a letter.

We have been told the badge holder must be there when the car is parked, so thats picking up out of the question.

This is from the councils website
Blue badges are only valid for parking when the badge holder is either driving the vehicle or being transported in it. The badge holder must be present at the time the vehicle is parked. If the badge holder has already been dropped off before the vehicle is parked, the driver cannot then use the badge

    From the blue badge website
The badge is for your use and benefit only. It must only be displayed if you are travelling in the vehicle as a driver or passenger, or if someone is collecting you or dropping you off and needs to park at the place where you are being collected or dropped.

i cant find the councils rules in any other blue badge website so who do we believe ? ? ? Also do we have to check every councils website before we park ?

Sounds to me like this person is an officious little twit and sneaky with it. Obviously has no idea how hard things are for disabled people and the family/friends who help them. Easy target??? He should walk a day in our shoes. Needs training in using common sense and compassion, I always think the type of people who do this job get pleasure from other people's misery anyway, you must be a certain type of person to want to do it, frustrated wannabe policeman? If it was me and I was given a choice of this or cleaning sewers etc. I'd pick anything else. As you can see this really riles me, not any use to you, but at least you know other people feel the same. Do as others say, don't let it rest, hope you get a good result, stand up for the little people.
