Just saying hi...iv just found this site.

I was diagnosed in the summer with having collapsed disc spaces and arthritis in my lumber spine, after a few years of achs and pains and just putting up with it, recently been told i have it in my fingers too.
I recently failed my ESA medical (got 6 points for not being able to sit for longer than half an hour without needing to move) and i am appealing, anyone been there?? no points given for pain on walking or being unable to bend without pain.
I was on JSA but job centre said i couldnt stay on it as i was incapable of work..............its sooooo confusing.

Hi, I'm sorry you are having to worry about benefit as well as not being well, its so unfair. I failed for the same reason and had six points for the same thing. I did appeal, but I have been told to re-appeal as my health situation has changed. I am sure I would have failed my appeal as the things I put down didn't seem to fit the rules. Anyway, I am trying again and I'll get CAB to help me this time!

Thats what I'd advise you to do. Lots of people do get awarded ESA but, a lot of them have help with the forms and go to the appeal with them. I'm sure I was silly in thinking that I could do everything myself! You will get ESA paid to you until the appeal at the basic rate. I feel slightly embarressed telling you to claim, when I got into such a state and withdrew, but do have a health reason for withdrawing, my MRI scan showed a gyne problem, which I have to get sorted quickly! Good luck.
    Love Suexxxx

hope your gynae prob isnt too serious and it gets sorted. im also awaiting a gynae op,and wont be able to work for several weeks after having that done, apart from the arthritis, but they just dont listen.
hope all goes well for you

Hi from us blokes too Gilly, sorry about the decision, seems an automatic no these days. You must appeal, as mentioned CAB can help, there is an organisation here in Leeds called D.I.A.L, think it is nationwide, they are very good at helping in cases like this..

    Best of luck

    Keep posting,

    Hi Gilly,

I don't know anything about ESA excet its unfair and often wrong in what it decides.

Iris (Dorcus) has done the most brilliant thing about it so often, bless her, I will try and find it and push it u for you. Its gong to take e a min cus I got a bit of discord with the brain tonight......

I so hope you can get some advice and you do go for appeal.... a lot of people win them. Nice to meet you. Cris x
