ATOS/ESA MEDICAL APPEAL

Good Afternoon All.

I have not been on here for a few months. I was beginning to focus too much on all the negatives in my life so thought I would get a grip of myself and now here I am new and improved again :smile:

Thought I'd post a quick message to encourage others.

In August 2010 I attended Atos medical for ESA and received zero points. I appealed and attended the tribunal a few days ago ..... AND WON!!

Throughout the meeting I thought that the Doctor was making me out to be a liar however at the end I gave a huge speech and when they called me back in with their decision both the Doc and Lawyer said they were impressed with my positive attitude and believed that I deserved ESA to enable me to focus on getting myself better health wise. I didn't take a representative with me as I have alot to say for myself :lol: And I did not take any back up letters from specialists as I wanted everything to be in my own words and I don't have alot of faith in my specialists.

Weh heh!

So, just thought I'd tell you incase anyone has an approaching hearing. Keep positive and it is possible to go from Zero to 15 points so keep at it if you need it.

    Goodness, well done you. a035.gif and you did this all on your own too! Good for you.

    I hope it does give others in the same position a bit of a boost and the confidence to fight their corner too.

    Well done you!! And how great were you all on your tod and making the speech (if that'd have been me my heart would have been in me mouth)....
    I bet they felt like plonkers afterwards and surely the person who assessed you and gave you zero points needs a good kick up the proverbial???

    Thank you for the replies.

    I hope that those of you that are awaiting appeals are given some hope by this.

    Try not to fret too much about the meeting being gruesome. Remember they are asking the questions to factfind and 'cos WE know we are telling the truth whilst trying to get to grips with our pain and our lives turned upside down we will naturally feel like we are being got at but they are just trying to find out facts so try not to take it personally - pretty impossible I know!

    Remember, ANYTHING is possible :lol:

    Hi,
    I'm so glad you've won, it must be a real boost to your confidence to have done it alone too, you are much braver than me.
    I won my ESA appeal and I didn't attend. I'd got myself into such a state that we decided that we could manage without the money rather than go through all that. So imagine my surprise when I got a letter saying I'd gone from 6 to over 15 points. :smile: I did write and explain why I couldn't face the appeal and appologised for waisting thier time!

    Yep, I understand totally fretting about it and so glad you were awarded it as the last thing you want to have to do is add to your stress worrying about money.
