Refused DLA for second time

Well, I tried for DLA a second time and low behold, in the space of say 12 days they came back with a decision..

To be honest I don't think they took everything I was saying into consideration, my HMS has gotten worse, I get sore walking down the stairs, in fact im in pain a lot in general yet im not eligible.... I am starting to think I need to be in the ground to receive DLA.

    with the amount of bank holidays etc, they couldnt have had anything from my GP, the letter I got was dated April 27th, I claimed on April 12th, and in that space there was only what, 9 working days. Rate our mail is at that wouldn't be enough time for anything. Considering I just received my letter today about my Student bursary and it was posted on the 13th April (and it only came from Edinburgh).

    Will you be appealing Pamie? I know it is a lot of effort when you feel poorly so can you get help from CAB?They don't make it easy I'm afraid but as you are in pain then do keep claiming.

    Of course I will be. I have asked my local MP for help and seeing CAB aswell incase my appeal is refused. I have a lawyer next door, so I asked him of what to write in my appeal letter. So letters sent off and just waiting now.

    HI Pamie, I had the self same thing, sent off a letter of appeal and the reply came back within a week!! to say the first decision was still valid. Of course they had not read, nor written to, or taken any notice of GP or Consultants letters in that time.
    Glad you are writing to them again, let them know it just as it is, how much care you need is the main thing to stress to them, challenge them on everything they have said. I know it is dreadful that they put us through hoops like this, leaving us feeling like frauds.

    I am so glad you have local support. Keep copies of everything and let's hope they actually manage to open their eyes and read, not just press a button and the computer sends out a rejection letter. Makes me so mad.

    Put it this way, I was just at physio on Tuesday. And that was the day I got the letter lol.

    I have basically said in my letter that I am disgusted that they have awarded those who have been swindling them but not those that actually need it and have a disability like us.

    Im going to log on the account I claimed from and print my form out.

    They have their own agendas now a days I think. Sorry they have turned you down and hope you do appeal and more importantly you are successful. Cris x

    Hi Pammie, I got refused DLA, And I was told you really need to get any letters from doctors and consultants you have photocopy them and put them in the pack as proof, if you have stayed in hospital recently photo copy the discharge letter cause it says what was wrong with you, any information with what is wrong with you photocopy it and send it! That way they can't say they have no proof! Also when you fill the forms in write it as how you feel on your worst day.
    I was taught all this and when I did it and sent all the copies of forms and letters and filled the form as I was told the 1st time got it for 3years and on the 2nd time I had extra forms and letters and I filled it as before and sent it and got it for life!! So I hope I might have given you some good advice, good luck with reapplying! Amanda, (bubbadog). :smile:

    Oh that is handy, I have a hand written letter from my GP stating what I have.... I may copy it and sent it with the appeal.

    Pammie, if you can get a letter from the physio and the gp and consultant and any other health professionals you see not only saying what you have but also what impact it has on your daily life.
    for example if you have trouble lifting you arms and the physio is aware of this them he might say that you cannot rasie your arms and this means that you have trouble dressing as you can't get things over your head.(this is just an example)
    If you can get this much detail in the letter from the gp etc then it helps as the dla people not only know what disease you have but also how it affects you ( i think unfortunatley they need to see it from health proffessional to believe it rather than taking our word for it)

    Hope you get on well with the appeal.
