dla refusal

i am reallt upset at their decision not to award me dla. I am 33 i have been diagnosed in january with osteoarthritis in both knees and hypermobility in my other joints. Life is so hard for i struggle to walk, struggle to get up and down stairs, am in constant pain. I am not allowed to take the pain killers usually used because i have kidney disease. I put on my form all my illness and what each one means in terms of effecting other illnesses and how can they say not entitled.
I have
depression for which i am on anti depressants for 5 years
underactive thyroid, which undiagnosed i put on 6 stone which i still have, on thyroxine for that.
Hiatus hernia, on medication for that get lots of heart burn
irritable bowel syndrome, which has me in pain for days when its bad
Chronic kidney disease for which i take 15 tablets a day for
osteoarthritis in both my knees, which cripples me, no pain releif
and hypermobility in my other joints.
are they having a laugh
i am so angry and upset its really untrue

I am so so sorry that you have been refused dla and I find it hard to believe with your condition that this was their decision.
I think you should appeal and try again.
I am sorry I dont know this procedure but I am sure some one will be along to advise you.

Hi,
I have been in the same position as you and i can recommend that you contact your local CAB office who have helped me no end. They have been so good with it all and took the worry out of it for me. I felt better after seeing them initially as they boosted my confidence and said that i should have been awarded it.
you can ask the DLA to look again at your application and if that fails then you can go to tribunal.

Hi, I got ESA on appeal a few months back, but now I've been called back in for re-assesment.
I've read through the form and apart from a few changes it is basically the same. I think, maybe, we concentrate too much on medical information and not enough on how it effects us. For instance, I have OA, in multipule joints, and like you, I'm in constant pain and when I really think of it, the things that I can do, both working and socially are badly effected. The depression and stress of being home and worried about this, has made me almost agrophobic, not to the extent that I won't go out at all but I don't like social things and stay home if I can. I'm frightened of walking out too far without my husband, as I've had a few falls recently, nothing much and indoors. All this should count and should be said. You're depressed, tell them about it. Frightened of falling, again tell them.
Sorry, I don't mean to rant on at you, but it sort of hit me the other day and if you look at the remit they have, thats also what they need to know, as well as the medical stuff, its how it effects you. Sorry enough said! :oops: Good luck, love Sue0 -
I am so sorry you have been turned down but it is quite common nowadays to be turned down with a first claim. You can appeal with help from CAB. Don't feel it is your fault, the DWP usually do this to see who will perservere. You are surely entitiled to it judging by the difficulties you are facing and the pain.
Keep trying.

thanks, i have spoken to local advocacy, who said to go the cab and they will send a referal to them, then they will help me, because i have mental health problems (depression), so with their help something might be sorted.
I have asked for copies of the gp report and rheumatology report.
I am due to have steroid injections in 2 weeks because mobility is very limited.
this arthritis and my kidney disease really do depress me, i feel today like i am about to hit rock bottom again, i am about to burst into tears, i want to go to bed and not get up, but my gorgeous 5 year old son will be home from school in 1 hour, and he needs so much looking after because he has chronic uveitis, hypermobility, severe language delay, possible autistic spectrum disorder.
At times all this things just seem to be too much and today is one of them days. :sad:0 -
Looking after a child (epecially one with problems themselves) is very hard when you are ill with multiple things. I was looking after my grandson (now 9) for a long while and he has ADHD which was undiagnosed and untreated at the beginning, so I had to fight to get that sorted. I can understand how you are feeling and that you have nowhere to turn and no one to help you, but don't give up (easier said than done) and re-apply and with help from CAB I'm sure you will be successful. Hi Princess
My application for dla was turned down too first time and even when I appealed it was again turned down and I felt like giving up. (That's what they hope you will do) but I was told by a friend who had the same problem not to give up, and go to the tribunal that was offered. I did and won. as others have said go and seek advice from the cab, and keep fighting dont give up.
