dla reconsideration

Hi posted last week about dla refusal.

I have asked for a reconsideration. They didnt recieve the consultant report back, so instead of chasing it up they sent one to the gp and made a decision based on that. I havent seen the gp for my osteoarthritis for 9 months, so they do not know how much i suffer, the pain, things i cant do etc.

I found out monday they did receive letter from rheumy in january telling them about my diagnosis etc but they didnt update their system with the information, so when the gp did the report for dla he went off me goin in the last 18 months with just pain in my knee.

I also spoke to the rheumy secretary who told me they had not receive the form.

I saw one of the gps on monday, told them all about my pain, limited mobility, she referred me the community occupationall services, for things like, bannister rails, higher toilet seat, grip rails in the bathroom and other things.

I am having injections in both knees next week, and seeing the rheumy again on 6th june. I spoke to dla again yesterday and they refuse to send out another report form to the rheumy, even though i told them that it was not received. They said its for me to prove now.

This just doesnt seem right, surely they have got this wrong. They could do that for so many people and that way they could just refuse dla and have no come back.

I am going to send a copy of the letter from january to them and when i get a copy of the june appointments letter i will send that too.

I just dont know what to do.

    Princess could you ask your rheumy to write a letter says what you can and can't do and also ask your gp to write one which you could then send to the dla

    Im so sorry you are having to go through all this, they really do want us to jump through hoops.
    I agree with Tracy try to get your rheumy to write a letter, but what ever you do, dont give up.
    It seems to be the norm having to appeal or ask for a reconsideration
    I do wish you luck with it.

    They seem to like basing things on an original form and diagnosis, they did the same thing with me, referring back to the 2008 report !! Hello, time has moved on and I am a lot worse, it took some doing, but I got the message across to them.
    Definitely ask for a reconsideration, in writing, (phoning them seems to achieve very little to be honest). I hope your Rheummy writes a full report, which includes the amount of care that you require, that is very important to stress to them, how much, how long, how frequent.
    Don't be disheartened, it is wrong, on so many levels, that we have to perform tricks and jump through so many hoops to get anywhere. Keep at them, keep copies of everything. The OT will write a report as well, if you tell them what has happened. Take care, XXXX Bubbles

    thanks everyone, the problem i have though is that i suffer with depressions and anxiety, and i won't be able to ask the rheumy to write such a letter, i would feel terrible, i wouldnt know what to say.

    You say exactly what you have written on here. You have given us a concise history of the problem, repeat that to him and ask for his help in providing a letter to support your case.

    It is difficult to ask them to write letters, I know, but if you tell them that you have been turned down for dla due to lack of up-to-date information and they refuse to send out another form to your Rheummy department, this would be a big help with your claim. If they say no at least you have tried. I asked my nurse to fill out the part of my form 'as the person who knows about my condition' and I thought she would say no, too busy, but she filled it out there and then!
    Make sure you get the OT appointment mentioned on your form too. You have been referred because your needs have changed.

    I have had my dla reviewed and was under the impression I could have the medical at home. WShen I phoned for an appt. they asked if (a) I could walk to the centre and (b) was I housebound. My reply was that it depended on how the aches and pains were on the day. Anyway a gp came round for the 'medical' (I had a friend with me) and I am now back on the same rates as before. This has been going on since Jan uary this year and caused a good deal of stress.
    Keep trying though, don't give up and if all esle fails contact Citizen's Advice.
