Tribunal appeal reasons for refusal....

Hi all
i received a letter listing the reasons why i was refused the mobility part of dla two reasons why they refused....

1. I had been working six weeks prior to applying for dla, they also list my job duties as a reason. But they have not said anything or even acknowledged that i had only started working for the company in jan 2010 and the first month was training in a classroom, from starting on the shop floor to going off long term sick had been just over six weeks, and in that time i had been of work twice....

2. They feel i cannot be that bad because i have not applied for a blue badge yet. Can they list that as a reason? But I suppose this is dwp they can do what they want, or say what tney want.....

This fight doesnt seam to have any end in sight.... But the fight will go on...

    Hi,
    I dont get DLA so cant say yes or no.....just an opinion.
    I think it sounds a very feeble reason ....Have you appealed.....stress about the training you did and the time off when you were actually working.
    Also as an Arthritis volunteer when doing information stalls and things like that I have come across loads of people who are bad but dont have a blue badge because they didnt think they were entitled to it unless they were getting DLA....I've a blue badge but no DLA....Have you tried for a blue badge now? Make that your next stop while waiting to appeal or whatever.
    Others that are more informed about DLA will be along soon I would think

    i think theyre giving out so many ridiculous feeble answers as they know that thats where they getting people like us, some just arent strong enough to fight the fight and give up so who wins??? the government, i think when they adjusted the DLA they just thought many would just accept it and leave it but there are many many more who have been treated extremely unfairly (like me) who will NOT leave it be....
    dont lose heart, claim that badge, speak to whoever you have to...

    I was refused twice in the late nineties.
    The first time was because I didn`t describe my illness and disabilities\abilities with the correct words.

    The 2nd refusal(after I`d had help from the CAB was probably because they were trying to put me off,according to the CAB!

    The disability advisor from the CAB advised me the words to use to describe my disabilities and how they affected me etc.

    I appealed the 2nd refusal and was examined by their medical person and had supporting letters from my gp and rheumatologist.


    I was eventually awarded DLA (high rate mob and mid rate care)for life

    (or 2013 as if the govt get their way)

    Don`t give up,go to the CAB and get evidence from your gp and\or specialists.

    Hello

    I haven't applied for DLA yet as I've only recently been diagnosed with RA...I'm still thinking about it. However, i was advised by an Occ Health person to be sure to appeal if your application is refused and to "stay in the system". I'm not sure if your letter stated if there was a limited amount of time to appeal but it might be worth checking out just in case if you haven't already.

    Not sure how helpful that is but just wanted to wish you luck with the good fight...hope it's not too stressful a process!...

    Thanks for the replies, I have appealed and the appeal is underway so just waiting to see what happens, and i have appealed the second application refusal, and now just waiting for the reply. I do have a blue badge application form so will try to remember ti drop it in at thedoctors tomorrow.

    I wont let them get away with it i will keep fighting.....

    Hi Mark

    Reading yuor post has really made me angry! DLA say that because you work you can't get DLA? That's just so wrong, they don't even know there own stuff, I work part-time and get DLA, have done for 5 years so that is a stupid excuse. I know you're off sick at the moment but still!
    I'm glad to read you are appealing, get that blue badge application in as well

    I think they'll say anything to deny people their RIGHT to the benifit system, I know of one person who had applied for income support and was denied it on the basis of filling the form out wrong. It's complete madness and I do feel for you

    You have every right NOT to have a badge...it is none of their business!!!
