Why??? Is it my time to be challenged??

I have been receiving DLA for just over 6 months and I have had to reapply because I only had it initially for a year.

I cant stand because my feet are so sore. My right hand has what they think might be carpal tunnel but it is still being investigated. I cant lift anything too heavy because I have spinal arthritis and I have shooting pains down my legs when I do. My shoulder is clicking in every time I move but guess what people....


I am no longer entitled to any help from DLA.


The reasons were:

- although my walking is limited I am not unable or virtually unable to walk (how funny I cant even walk from the bedroom to front room even though they are next to each other because my feet hurt)

- I dont need help using kitchen utensils (no I dont I cant hold the bloody things let alone use them)

- I can carry and lift safely (is that why I have to get relatives or friends to help with shopping or to get shopping online)

How the **** does anyone know how this feels and how I cope with it? They asked for my specialists details which I gave them (he has only seen me once) and they have gone on the specialists opinion of how I am 'improving' since I had my epidural.

Why is it that they think they are qualified in all kids of medical knowledge when they only sit behind a sodding desk?!!!

Sorry but I think after everything else that I have had to cope with and the stress of it all I just dont feel able to cope with anymore.

I want to be able to get on with my life as best I can but these jobsworths are making it so much harder.

Yes I have asked for it to be looked at again and I have given them more information but I dont know if that is going to make things any better for me.

It was sent by a Miss too so she is probably in her early 20's or a temp and no understanding how things affect people. And even better there was no leaflet in it to tell me what to do if I disagreed with the decision.

Sorry rant over. Hopefully I will be back to my happy normal self tomorrow.

    Hang on Jaki it's the fecking machine, don't let the b*****d's get you down so soon, these people are feckwits lifes full of them they hope you'll just bugger off, if you do they have won it's probably why they had no leaflets about the DLA as they don't want you to come back so they arn't going to tell you anything that will assist you, just take deep breaths for a bit and soon others will come along on here who can advise you about the next steps you need to take, there are many on here who will know what you can do so hang in there kid you'll get there just don't give up hope ok!.

    One word Jaki APPEAL...they are just trying to wear people down...and picking on the vulnerable is the easier option...they have been instructed to bring down the amount of people getting benefit.....but alas they pick on the wrong ones.

    dont give up, fight it. i know it is hard as we have enough to fight just to get through the day without this rubbish, dont let them rob you of what is yours.

    I know it's hard to have the energy to fight things but you need to so it can benefit you. . I am just starting an appeal for esa and am being helped by C A . B they have taken a lot of the pressure off my shoulders. . I'd give them a ring so they can assist and advise you.

    Hi Guys

    Thanks for the information. I have phoned to talk to someone to find out what my options were. I have given more information and I have asked to be reassessed. I have been told that if this outcome is still negative I still have the right to appeal.

    I have decided to give them a chance to redeem themselves and to get it right before I go in all guns blazing. The woman I spoke to was really sympathetic and she was able to put my mind at rest a bit more. The stupid thing is last year when I applied and I had a slipped disc I got it without any fuss. This year when I have been diagnosed I dont get a penny. That is totally out of order.

    Anyway guys I am off to have an early night and to get my head ready for my interview tomorrow. Thanks for being there to let me rant.

    Hi Jaki I'm really angry :x for you how dare they say what we can and can't do when it's not them in pain. I'm with Barbara on this one word appeal. CAB can give you lots of help if you ask. Good luck and let us know how it goes. :smile:

    They picked the one glimmer of light about the epidural op improvements and assumed the rest of you will follow. They have contradicted you on your walking ability and holding utensils. It seems they have to 'lie' at the first reply stage now. As Mell said it is part of the machine.

    Hi everyone and thanks for the advice.

    I am feeling a bit more up beat about things now. I have my new computer in place and I can now see what I am reading/writing lol.

    It is going to take 8 to 11 weeks before I get an answer on this but it is in motion so to speak. I might try to get to see someone at C A B soon but I want to really give them a chance. I am also off to see the original doctor who saw the pain for what it was and not anything else. He was the first one to say 'yes you need to lose weight BUT we need to sort the problem before we can sort that'. He was the one who originally wrote to the DWP about my DLA but unfortunately he was only covering at the time. I am seeing him tomorrow as he is back covering so I am going to see if he will contact the DWP on my behalf. I might even see if he will ring them while I am there. He should know that I am not putting this on and he will be able to do something. I have faith in him.

    The interview however went well as far as I could tell. I will find out by the end of the week if they want me back for anything or to start the process of health checks. I was honest with them and said that I had been off sick for some time prior to leaving my job but they would still (I hope) give me a good reference. I had never had a bad word said against me and I was always willing to work extra hours as required.

    They were very positive about the fact I have arthur and they would do a risk assessment to ensure that everything was in place for me which I thought sounded positive. They are the first firm that I have been interviewed by who dont see this as a problem and panic about it. They seem to understand which is good. Just keeping my fingers crossed now.

    Not such a good day as planned. I went to the doctors as planned to see the one doctor who actually understood things and guess what - the useless doctor who I had seen the week before and doesnt know up from down was in instead. Typical.

    Anyway was told that Good Doctor should be in on Saturday between 8 and 1 so guess where I am going saturday morning. I am going to try to get this sorted and see if he can write a report for me to send to DWP. He might do it as he does understand.

    Apart from that I have had a day of sorting out and getting rid of things no longer needed. I just didnt realise I had that much stuff LOL

    The only thing I can say is that I had to appeal after my first application and it took nowhere near 8 weeks for them to award me the claim. Don't give up and if all else fails, try your local M.P. In my experience they really help. Be sure to include your name, address and postcode when writing or emailing tho. Good luck. You CAN do it.

    I will contact my MP and see if there is anything they can do. I hadnt thought about contacting them so that is another direction I can try.

    Feeling a bit better today.


    I found out that I didnt get the job I had an interview for. I am not sure what they wanted. The reasons they gave were the fact that 1) Someone who had more experience than me using the systems that they have in place and 2) that I was not dressed suitably for an interview.

    Would anyone like to enlighten me on what should be worn to interviews instead of suit, blouse, flat shoes. I was surprised to say the least. Everyone I have spoken to is of the same opinion - it was just an excuse not to employ me because of arthur. If I hadnt told them I would be accused of keeping something from them. Because I am being honest I am being penalised. Its a no win situation.

    UPDATE: My doctor who wrote my original report for DLA last year is going to be in touch with the DWP re my DLA claim. He was not impressed that I havent got it and he told us that my hubby should be receiving it too after the recent episode in hospital and the fact that his chest is seriously damaged now and it wont get any better.

    I am going to be logging hubby's claim tomorrow. I have written to the MP who happens to be the MP for Disabled People (not sure if that is the entire country or if it is just my area) so hopefully something will be done there.

    Still trying to get hubby's medication sorted and even though we saw the really lovely doctor today because it is a walk in surgery as well as a regular doctors he didnt have access for registered patients as he had been locked out of that part of the system and no computer bods available, so he has asked hubby to go back during normal hours (8-8 Mon - Fri). He didnt think it would be an issue giving him the meds but he wants to double check what meds he is on currently and also because he doesnt have a say in the spending he needs to ensure that it doesnt need to be treated as a private script. Worse case scenario we get them privately.
