The job application form itself should not ask about any disabilities.
This is to give disabled a fair chance of an interview invite and then being offered a job based on their competence. Its only when the job has been offered they can ask about any disabilities and so that reasonable adjustments can be made.
If the application form is asking for anyones disabilities thereby probably predjucing their chances it is against the law and the applicant should contact the....theyve changed their name..but it was the equalities dept..check with AC.
I would contact the government dept, whose new name has escaped me, and tell them the form asked for your disabilities which is against the law and you feel you have been discriminated against, mention you have past experience in restaurant environment so you did have a competence to prove your suitablility for the job.0 -

Really, I didnt know asking on applying about disabilities was against the law :-/I ♥ Runrig.

They cant ask about your health on forms-at the beginning.
On old forms I have seen a self declaration if you think you are covered by dda etc.
If you think about it..its unfair to ask as you dont get a chance. Wheras if the form you have filled in shows you meet what theyre looking for, then you get an interview then you sound like the person for the job etc..if you put disabilities first the employer could form a wrong impression about you.
What did the form ask?0 -
It was asking if I had a disability and if I did what was it.I ♥ Runrig.

I found the website..its EHRC...have a look!
Before you complain to employer it might be an idea to ring them first.
Info on there gives good examples about how to phrase things, such as I have such a such a condition however I am able to do x y and z.
I rang them once about job forms and the above is what i was told. I have had a look just now on their website and it seems to say the employer can ask at some stage in the recruitment of your health issues etc but I guess its the way they ask and the way you reply.
If you have done a similiar job before it doesnt seem right if they have dismissed your application.
Sometimes they right you off when you complete those multiple choice boxes-I think theyre the daftest ones Ive seen.
A while back when I filled out a job form, but laws change, i ticked the disabled box and was asked at the interview. I said what I had but said I can do the job well if you provide adjustments such as, special chair etc.
Also, they have to fill so many posts with staff who are disabled so they cant say no to everyone.
I would ring EHRC on Monday then ring the employer and explain you feel its cos of your disability (if ehrc say thats right way of going about it) and say you feel let down - you never know you might get a nice person on the other end to give you a fair chance.
p.s. they do ask if you will need assistance attending interviews sometimes e.g. if its on top floor and it would be difficult.0 -
I am not sure if we can copy stuff of other websites so I have sent you a PM with a copy and paste of EHRC website about job application forms.0

Um..makes you think doesnt it! perhaps mcds are using old forms?
Sports direct - I was chatting to a young assistant in there once, as you do, and he was about 19 yrs old and due to vigourous sport had knackered his tendons completely and had implants - so you see, theres a sport shop where you think you would have to be v sporty and they employed a lad whos tendons literally snapped and he cant play sport. He can advise on sports wear, footwear etc as thats whats needed for the job not to run around doing athletics!. Youre into football i vaguely recall so you would relate to customers about that.0 -
Yeh totally.
Yup, I play a little bit at the moment, trying to get my fitness back up.I ♥ Runrig.
