esa appeal question

does anyone know what happens if you loose the appeal and can you appeal the appeal disision. i have my appeal next week.

    I think if you loose the appeal you can apply again..check it out on the government website/esa... type esa appeal into google and it should come up for you..Any problems either ring them up or contact CAB..

    hi, if you lose your 1st tier appeal you can only got to 2nd tier appeal, if its a matter of case law.

    I was told this by a lady at dial.

    good luck on your appeal i know how stressful it can be..but I found them very nice and understanding.

    for me it was very quick in and out in 10 minutes.lucky I won (thank god)

    Hi,
    I think if you google, as suggested you will get the information you need. Or you could ring the CAB, I'm sure they will give you useful advice.
    I don't think you can appeal the decision unless their is a point of law which the appeal board got wrong as someone else suggested. Again CAB should be able to point you in the right direction.
    If I remember rightly, (I won my appeal, but had all the paper work and stuff I could get), you can apply again, as if you are a new person. I think that is right. As by now if the time scale is anything like it is here, you may have been waiting quite a good few months and your condition may not be the same. You may have seen more docs and have more ammunition to throw at them! :shock: . I don't know if you have to wait at all, but I'm sure DwP will tell you, either on its website or by phone.
    Sorry to make this such a long post, but, its all so complicated, insn't it. I think they do it to put us off applying! :|

    We all know..almost everyone gets 0 points..i think they do this to weed out those can appeal and those who cant..as Arthritis care have already stated many times the whole system is not fit for purpose and the sooner they get its sorted out the better..and I still dont understand why atos get paid a bonus for eveyone they fail even if they win there appeal or not..so wrong.

    I just wanted to wish you luck for next week. it is all very stressful and the system certainly seems to be stacked against us.

    i would just like to thank those of you who posted and wished me well with my tribunal. i just wanted to let you know i won, so there is hope out there for others who are going through this nightmare. keep fighting, at some point you come across someone who shows a bit of comon sence and care.

    good luck to those of you who are still going through this battle. and once again thankyou to everyone who has suported me from the start to the finish of this process.
