Failed DLA Claim

After Winning my esa appeal, I decided after reading the dla website that I qualify, so I applied online and got a letter telling me I have failed in my claim..citing that I can walk 200 yards..Yes I can walk 200 yard and I am in damned pain for most of it as I stated in my esa appeal ( for which they agreed.)

For some reason they have decided in there wisdom to choose which parts of my esa medical to actually read and use to make there decision.

so here we go again..

    Keep trying as they tend to turn down first attempts. You will have to appeal. Try to get some help with filling out the form from someone with experience such as CAB.

    Congrats on the ESA appeal. Keep plodding with DLA, don't let the b*s*a*d* grind you down!

    I was So positive that I would get it without any issues..I thought that they would do the decent thing and read the full medical and the appeals notes and HAY PRESTO.. job done..

    but ohhhh noo thats just too easy.

    Appeal, and you need help when filling it in.
    Never write distance in write various and explain it at the end. This goes with things like standing and sitting ect.

    Just what i have learned in the work i used to do.

    Do appeal though, good luck.

    Sorry to hear you have had bad news.

    This booklet by the NRAS is excellent - it talks about claiming DLA from an arthritis sufferer's perspective:

    I don't qualify for DLA myself but I have helped some disabled customers at work to apply with quite a bit of success. You need to make sure you answer the questions in the way 'they' want you to.

    I now realise that..after reading the disability alliance website.

    I did mutter to myself..at least i can appeal and put it all in the letter i will be writing.

    Do appeal hun, it can be a bumpy road, no pun intended. I had to spell it out, time after time, with repeated letters from GP and Consultants.

    It is so frustrating, on the point in question, about distance, they ask how far etc, before you are in considerable pain / discomfort, well I stated that the pain and discomfort is already there, before I even start, hence I can only manage very short distances.

    Sadly, many first time applications seem to be turned down in a flash, but do keep going, every scrap of evidence and keep a copy of everything.

    They used my medical I had for esa, which states all the information that I put on the form for DLA..I do wonder if they ignored the fact i won my esa appeal and soley used the flawed report.

    Hi, yep don't give up I got refused even for ESA and appealed it and won and then appealed my DLA and got the lowest rate for that only cause at the appeal they covered the bit about could I turn a star head tap which I can't so that awarded me it even though my doc, physio, occ therapist and rheumy had done reports they chose to ignore that. I did have the help of a very good man from welfare rights who helped me with both my cases and when my DLA runs out in Nov I will be going back to him for help with the forms but also will now read the link above for some advice.
