well done you shouldnt have to go through all the appeals and stress that it brings if you have certain illnesses you should get it automatically i received my form yesterday going to c a b for help sue x0

Thanks everyone, it's a huge relief and really helps me financially too. I won't be such a burden. The backpay has almost got me squared up with the bills too.
Sticky et al, come and have a glass of something pink and bubbly with me. I must only have one glass cos it has a strange effect when taken with the Zomorph lol.
On a plus side it's an indefinite award so until the damned PIP comes in I shouldn't have to jump through these hoops for a while.
Now for the ESA ......

Sadly Ms Legs, all of it is going on outstanding bills. Which does mean that it should make the monthly budget easier to manage and maybe I will be able to afford a hair dye to hide the copious grey hairs.

Woo-hoo! A joy shared is a joy doubled. I got mine indefinitely in Dec. 2009, HRM, but no care. I'm not at all sure I shall keep it, looking at the criteria for PIP - which is being trialled in my area, so I have about a year I reckon. But for now, rejoice!0

I'm appealing my decision atm. I know a few people who also have Fibro (that's my main problem, since I applied in November it's looking increasingly certain that I have Arthur of some description) who have won at appeal, or at reconsideration. At the moment my paperwork is due to be reviewed by a different decision maker. So I'm hoping I get lucky and get one who will make me an award and save me an appeal hearing. If not - bring it on. I can talk for England and I'm stubborn. They won't know what's hit them0 -
It was a huge but lovely shock as I hadn't had any letter. I had gone into my account to see if I had enough left on my overdraft to top up the electric key before Easter and was stunned.
Tbh I am shocked I got awarded it so quickly and for indefinite period as last time I applied I was turned down completely. I didn't do anything about it then as I was just too tired but since reading up a lot on it all was expecting and determined to have to fight for it.
All I have to do now is fight the ESAs decision, which is being a nightmare as they don't ever respond to my letters.

Had a letter last week, maybe week before, saying they've received my appeal letter. Should hear in about 9 weeks or so if they've changed their minds.
Worst case scenario is that I have to apply again with an extra illness. My Arthur has really kicked in since the new year, annoyingly just a few weeks after I sent the form off. Would be a shame to lose the backdated payments to 25 November but it's better than nothing. I wish I'd mentioned some of my new symptoms on it but it didn't occur to me. So now they can't take into account Arthur unless I apply again. But I was definitely eligible beforehand anyway so hopefully justice shall prevail.
Just got to hope a decent decision maker reads my form. And I hope my 3rd Rheumy is a good one and will write a decent letter explaining all about my HMS, Fibro, RLS and whatever variant of Arthur I have which will help to back me up. They made the decision before they received my last Rheumy's report which is annoying.
Oh well, just got to keep fighting the system and hoping for the best! It's good to see cases where the system does work, gives us all hope that some people at the DWP do give people the help they need.. eventually! x0 -

PIP could be Personal Injury Protection but I'm not sure to be honest. :roll:
DLA is reviewed approx every 4 years ....again anyone correct me if I'm wrong.
And I'm not sure about Council Tax Reduction with Severe Disablement Allowance - I don't think you get any.
Well I wasn't much use was I? Hope someone better informed comes along. (We used to have a member called HobNobBob who was the expert on all benefits but sadly he no longer posts ..............another bit of useless information from Legs :roll: )

Hi, sorry guys PIP is personal independent payment. It is what the government are replacing DLA with. Even if you get an indefinite award you will still have to go through the new tests to qualify.

What is DLA reform
The reform of disability living allowance (DLA) will mean that DLA will be replaced by a personal independence payment (PIP) for those of working age from April 2013.
As yet there are no plans to extend PIP to children under 16 or claimants who are over 65. However migration from DLA may apply to these groups at a later date.
Part 4 of the Welfare Reform Act contains proposals to introduce PIP.
Where can I find out more?
Disability Alliance has produced Factsheet F60 - personal independence payments which gives a basic introduction to the proposed personal independence payment (PIP) based on what we know so far. This will be updated as we get more information.
There is now a second draft of regulations on the proposed new disability test for PIP. These will be subject to further development and consultation. They are available at http://www.dwp.gov.uk/policy/disability/personal-independence-payment/.

Background
On 22 June 2010 it was announced in the Emergency Budget that the Government would reform disability living allowance (DLA) and introduce an ‘objective medical assessment’ for all claimants from 2013-14
In December the DWP published a consultation document on the reform of DLA which sought views on the Government‘s proposals to replace working age DLA with a new benefit – Personal Independence Payment. The closing date for responses to the consultation was 18th February 2011.

Welfare Reform Bill
Prior to closure of the consultation the Welfare Reform Bill was introduced on 17 February 2011. This set out the main outline of PIP in Part 4 of the Bill:
Personal Independence Payment will have two components - a daily living component and a mobility component
Each component has two rates:
daily living component standard rate
daily living component enhanced rate
mobility component standard rate
mobility component enhanced rate
Government response to the Welfare Reform Consultation
On 4 April 2011 the Government published its response to the DLA reform consultation. The response maintains the Government committment to the introduction of personal independence payments for working age claimants.
With regard to the Daily living component the response says that the activities are:
planning and buying food
preparing and cooking food
feeding and drinking (taking nutrition)
managing medication and monitoring health conditions
managing prescribed treatment other than medication
washing (bathing) and grooming
toileting and managing incontinence
dressing and undressing
communicating with others
The mobility component should involve planning and following a journey and moving around.
When considering aids and adaptations PIP will only consider aids and adaptations that are "available and are successfully used by an individual".
The response also confirms a commitment to a six months "backwards test".
With regard to Children and people aged over 65 the response says:
"27. We do not plan to extend Personal Independence Payment to new or existing claims for children from 2013/14. The needs of children are very different to those of adults and we would want to build on our experience of developing the objective assessment for claimants of working age before applying it to children. We would also consult before extending any objective assessment to children.
28. Individuals already in receipt of Personal Independence Payment will continue to receive the benefit past the upper age limit of 65, provided they continue to meet the eligibility criteria. We will use the experience of reassessing the working-age caseload to inform any future decisions on the treatment of this customer group."
With regard to mobility payments in care homes the response says:
" 29. The Government has listened to the strong concerns raised by individuals and organisations about the Spending Review proposal to withdraw the DLA mobility component from people in residential care. The Government will not now introduce this measure as planned in October 2012. We are both reviewing existing and gathering further evidence to inform how best to proceed. Meeting the mobility needs of people in residential care will now be considered as part of the wider reform of DLA. The Government is committed to ensuring that residents of care homes are able to get out and about, and is therefore looking to remove overlaps in funding, not mobility."0 -
