DLA Tribunal

Got my DLA Tribunal on 8th May and am shattered.

My welfarebenefits guy has basically told me today that there is not really any point in me going to it as it won't change hte outcomes. x

    Not sure I agree Pink

    I'd be inclined to go anyway...........even if the decision doesn't go your way, at least you will have given it your best shot.
    If they conduct the tribunal with you not there, you will always be wondering what was said and done.

    i spent all of last year sorting this out as my renewal was turned down, it went to appeal and tribunals etc... still got turned down but gave best shot, in the end went to the CAB and they said had my condition worsened i replied yes so we have tried this route my daughter will come to the hearing with me, i have so much more trouble doing many things others take for granted i wont give up without a fight so this time im going to see them in person i have nothing to lose,

    I would attend the hearing. Everything I've read online, and been told by the CAB (am appealing my DLA decision too, got a letter yesterday saying it was a still a no and they're sending my details to the tribunals service) says that you're significantly more likely to get an award, or a higher award if contesting the wrong award, if you attend in person.

    This way they can at least ask you to clarify anything that they are unsure of, rather than guessing or making assumptions which might not be in your favour.

    Hiya

    Just to say i agree, go to the tribunal, at the end of the day the only person that knows how bad you are is you, you have nothing to lose by being there, that way they get to see the person instead of just a name,
    Good luck and hopefully they change the decision x

    can just inforse what has already been said Pink, if you dont go you wont know, at least they can see you for themselves.

    I agree with the others Pink, you should definatly go. What does that benefits guy know what is going to be said by the tribunal people, At least you can look them in the face and let them see how disabled you are and if they want to ask you any questions you can answer them in front of them. It took me 4 years to get my DLA back after having it before for 2 years. They made me reapply every 12 months at 1st then it went to every 3 yrs after winning back my DLA and now got it for life. So you keep fighting pink!!

    HI,
    If you go to the tribunal, at least you will be able to know you've done all that you can. I know how hard it can be to have to go through these things, but you may well be surprised.

    In the end, though, its your decision and if you can't face it, write and tell the tribunal why you'r not their and if you can, submit a doctors letter to say that its effected you mental health. Thats what I did, and I won! That was last year for ESA, which ends for me at the end of April, as these days its only available for a year, unless you meet certain critirea.
    Good luck, what ever you do. At least a tribunal shows on the Government figures that you do have a problem and not just walked away. I believe, if nothing else, be a gov. statistic!!! :lol: Love Sue xxx

    Hello Pink :D

    I agree with what the others have said... it's always better to attend and hear first-hand what is said.... you will be given the opportunity to speak for one thing ... and to take a representative with you too for support, or to speak on your behalf.

    I'm with the others. If you don't go, and get refused, you'll always wonder if it'd have made a difference.
    If at first you don't succeed, then skydiving definitely isn't for you.

    Hi all.. just wanted to say I'm also in the same situation, was turned down for DLA at tribunal in Sept 2011, then reapplied as my condition had worsened!
    Got turned down a 2nd time by letter, have reapplied again and now going to DLA tribunal for the 2nd time in less than a year on the 30th of APRIL!
    so completely understand how you feel, angry mad frustrated, pissed off that we always have to jump into these hoops!
    Yet I have a friend who has a child who has a condition but not serious and life threatening , but gets highest care allowance dla and the child's 14yrs old,is in a naughty school cause he burns stuff and just naughty the mum will tell u that! makes u mad.

    all the very best for the tribunal, i too agree with everyone, you should go if you can, its the not knowing thats the worst, i lost my money a few years back and had to go to tribunal, and it passed quite quickly, the things we have to go through is ridiculous, like were not suffering anough. anyway again good luck and try not to worry too much, its just not worth it honey xx
