1 year ESA is up end of april, advice please.

Hello all hope Ur well so to speak or not as in much pain today!
not been on here for a few months to post, but have been checking in now and again to read post's !
Need some advice please as DWP have confused me.. don't take much..ha ha !
But my question is, I have been on ESA for 1 yr and it runs out end of April, how ever I have had a letter to say my contribution ESA will stop, when I rang them they said the contribution ESA will stop but you will stay on ESA still at the normal rate and still get what I'm receiving now every 2wks???
Anyone else in the same boat or been in similar situation please??
Also just had my ESA atos medical again with the evil dr's who say NO!! but waiting for reply with the results!

I got exactly the same letter last week. It says my contribution based ESA runs out on 30th April but that the rate of ESA went up on April 13th...It told me on the last page the rate I would continue to get which is the same as before (was £94.25 now £99 app)....It is now called income based ESA and for me that is okay as I still qualify for my HC2 form which i get prescriprions, dental and basic hospital travel costs whcih i really need. I havent been called for another medical but that may come as well, who knows how they work this inaccurate system?

So it does't stop, mine said it was going up too £99.00 also !0

This is very confusing but I have managed to unravel it as I am in Appeal with them.
If you are in the work related activity group you will NOT get Contributions based ESA after one year.
If you are in the support group you WILL continue to get Contribution based ESA.
If you are on a low income, basically that's worked out as £105 per week for a couple the you CAN get Income based ESA, instead of Contribution based.
If you OR your partner work more than 16 hours and over the £105 a week you will NOT get Income based ESA nor will you get Contribution based.
I got both letters too but I am NOT getting ESA after a year because I am in the work related activity group, which is wrong for me, hence my Appeal.
Sorry if this upsets anyone but that's how it is

I think Folara has stated it better than me but no think youre getting same as me...It did state at end of letter what I am entitled too and broke it down but did initially scare/panic me!!

I explained all of that on another forum and got told I was just trying to scare people and was jealous as I am having to Appeal
Mind you that other forum is a bit full of oddities of life and not nearly as lovely as here.

I am confused?
My friend is reaching the year contributory esa, she is classed as disabled and too ill to work but her husband works 40 hours a week, therefore does ESA stop or can she continue to get it even though her husband works? They have no savings and are behind with mortgage payments, she is worried to death0 -
Hi kittymedaughter,
Basically you only get 365 days on contribution based ESA IF you are in the Work Related Activity Group.
After the 365 days you can get Income related ESA but ONLY IF you are on a low income of I think £150 a week, or thereabouts. If you OR your partner work and your JOINT income is over that then you get NOTHING. Your partner is expected to look after you. There is also a limit on savings too.
IF you live alone and therefore your ESA WRAG is your only income (DLA is not income based so therefore ignored for this) then you will get ESA that is income related for an indefinite period. This would be the same if you lived with a partner but they were on a low income, eg they could be a carer.
IF you are in the Support Group you will continue to get this no matter what the household income is and for an indefinite period. Again tho if your savings are over a certain amount this then affects how much you get.

Oh and forgot to say, if she's disabled she should also apply for DLA and for the enhanced disability premium IF she is awarded Higher Rate Care from the DLA.0 -

Thanks Flos, I will tell her, it will ease her mind, she has applied for DLA, at first they said no, but she appealed and it is being looked at again...Thanks for explaining it to me0
