Tribunal win for DLA claim

Hi All,

Just a quick update, I went to a tribunal hearing on Tuesday 01 May 2012 and won, it was the best feeling ever and it didn't take twelve months as I was originally advised!! I have been awarded the higher rate mobility and the lower rate care so that was a better result than I could of imagined because I thought that if I was going to be awarded anything then it would just be the lower rate mobility.
I am just waiting for the confirmation to come from the DWP - not to sure how long it will take them to do that as we all know they are not very quick when they have to part with anything but are really over speedy when they are collecting in!! lol
Anyhow, I hope that this will inspire anyone else to fight when they are being told no.... Also, I did not take a representative with me, my husband accompanied me but did not say anything to the tribunal he just sat there next to me, so you can do it on your own if your claim is genuine

    Excellent news, well done.

    It's a shame us genuine people are made to jump through hoops to get what we need. Thankfully they saw sense for you.

    For those getting ready for your appeal, make sure that you put in a statement explaining your everyday needs and pain levels and put in as much info as possoble, I included copies og=f my medical notes and letters from my consultant to my GP as my consultant did not give them enough info, he just wrote thema short letter and did not bother to complete the form that they had sent to him!!

    That is really very good news Jules.

    I am waiting for my appeal and went to see a CAB adviser on Tuesday.

    She is a magistrate and part time adviser and told me the worse case scenario. I wonder if yours was anything like this:

    Do you work? If so how do you get to work? If you drive to work you will fail!

    Can you drive? if so how far? Is your car manual or automatic? If you can get into/out of a car then you will fail. If you can drive long distances you will fail.

    Do you walk? You are not telling me you don't walk at all? How far do you walk? if you walk you will fail.

    Can you make a cup of tea? If the kettle is heavy just put in enough water to make one cup. No need for DLA!

    Can you open a can? If not can you use an electric can opener? No need for DLA!

    Can you stand up? If a man - how do you shave? If stand to shave you will fail!

    She went on and on until she convinced me I would fail. However she will prepare my submission but not attend as there is no point - any advisers and witnesses can only have limited opportunity to speak.

    On the other side of the coin if there is surgery on the way (if you are on a list) or had recent surgery to do with your condition that should help.

    It really did put me off but I now have some encouragement thanks to Jules.
