Something I have wondered about and can't find the answer to. When you get your ESA decision and they backdate it, is it backdated to when you first applied or to the medical assessment?
Might not even apply to me yet if they put me on JSA and I have to appeal, but thought I would ask anyway.

    Hi pollysid

If you fail and your going to appeal get straight on the phone tell them your going to appeal and that you wish to stay on was at the assessment rate. Then pull the report apart in a letter stating why you should have got 15 point and what they got wrong, what they assumed, what they left out and so on.

Once you have won the money is then backdated to the 13 th week at full rate or if like me this is my second medical from the date of your last full payment.

    Hope this helps

Well they do make it complicated don't they

These things should just be backdated to the date of claim :x

ahh well because there are 3 rates for ESA, assessment rate and then the two main rates..wag or support.

the last 2 is only paid after 13 weeks ( which is the assessment rate). if you appeal you can still claim the assessment rate but once you have won your appeal only the extra topup will be paid, either wag or support rate. from the end of the 13th week.

since jsa rate and esa assessment rates are the same, the only difference is that with esa you dont have to be looking for work while they are looking at you appeal.

I think they like to confuse us to stop us complaining lol.

There is a new legislation in the pipeline now that if you go to Appeal you will no longer get the assessment rate but will get nothing. Then if you win it will be backdated.

Another way of stopping people going to Appeal.

thats mad..what are people supposed to live on..so then I take it you will have to sign on to JSA until your case is heard..totally disgusting.
