DLA Application Refused - Help please

Hello guys

hope you are all well

You may have remembered me posting on here , not so long ago about applying for DLA, I got a letter today saying it's been declined. Main purpose was to get help with my driving, as I cannot drive more then 10 minutes without my legs aching. I have juvenile arthritis along with other medical conditions some being Leukopaenia , Autoimmune hepatitis and Lupus SLE , which i've had for over 15 years now.

I just wanted to know if anyone else has been declined before, an what the appeal process is ?? if you have any hints and tips for me , would be greatly appreciated , whatever it may be.

    Hello again, Waqas. I do remember you and I'm sorry you've been turned down. That seems to be a regular occurrence on here :roll:

    I'm sure someone with more experience of these things will be along soon to help. Meanwhile, I can only suggest that you ask about adapting your car. There are lots of ways this can be done. Good luck!
    If at first you don't succeed, then skydiving definitely isn't for you.

    Thank you , I have looked in to it and it seems to be very expensive, i go london on a regular basis by train aswell , so i spend a lot of money going to hospitals . Hopefully I can get some help from someone who's been through this before.

    I think you need to get some help to appeal. I suggest CAB or DIAL. They will look at your application and see if you have grounds to appeal.

    I am so sorry, DLA is getting really hard to get these days

    Thanks for replying

    I've heard some bad stuff about DIAL , where they are telling people not to apply because they will get straight up declined , but will try the CAB to see what they can help with.

    I would suggest CAB as I have been fortunate that I didn't need to appeal, you say you travel and go to a lot of hospitals, if you are on benefits you will probably be entitled to travelling costs through the NHS, I get travelling costs paid as I go to hospital every three weeks for treatment and got flights paid for me and a friend when I was sent to London to see a Professor over a year ago...............Marie x

    On no benefits at the moment , am 23 and live with parents, i do work a few hours a week just to get out the house , but find the money I earn goes towards costs to go to hospital , i must spend over 200-300£ a year on travel cost's to hospital. Do you know the name of the benefit , which allows me to claim back off the NHS for travel costs ?? i go every 3 months , sometimes i go every month or so , as I see 3-4 different consultants.

    The name of the benefit is ESA if you are on income based you need to show proof of receipt of benefits (an award letter) or if you have contribution based ESA you can get a HC2 form..Re the HC2 form as cos if you don't have much savings, or only work part time may be worth filling in the form to see if you are entitled...It can't hurt...

    Waqas the name of the benefit is NHS Low Income Scheme If you earn less than £15.000 you may be eligable. Ask at the hospital. If you only work a few hours then Job Seekers Alllowance may apply to you, that would enable you to claim hospital travel costs too.

    I take it you have already aplied and been turned down for ESA. if not then you should apply

    Thanks ever so much for the help and advice :) I earn £8k a year ... will apply for the low income scheme , as it looks like i may be eligible for this and will also give the DLA another go with the appeal.

    Waqas any hospital should keep the form that you need for the LIS again good luck, and well done for working even though you ahve health issues.

    Thank you i'll query it when next in London :) ... && thanks for the kind words , it's not easy working most days , but it' good to get out the house i suppose.

    Waqas, I see you have had some some info from the others, as lululu said any hospital will have the forms(i.e. your local) that you require, if you go to the cashiers office they should be able to advise you what you are entitled to and what forms you need to fill in. I was on JSA then ESA so automatically got it.

    Good for you working and getting yourself in and around company, which helps as well to distract you from your pain. I am glad to see you are gioing to apply again for DLA as it is said on here often say it as it is on the worst days, keep us informed how you get on, you know you can come on here any time to ask.............tc...............Marie x

    It was not until recently , i went to the council to ask about parking, and they said i may be entitled to a blue badge, which i got last week and helps a lot , from their i applied for DLA after speaking to someone , I rang DIAL today and they told me I got no chance of winning the appeal again, which kinda through me off abit , but i'll give it a go anyway.

    I'm due a visit to my local hospital next week , so will have a word with them about the low income scheme and see what am eligible for.

    Will keep you in the loop about what happens , thanks again for all your help .. greatly appreciated.

    Hi,
    Firstly the DLA appeal. When I initially claimed I was refused; I appealed on paper - refused. 18 months later I tried again - refused; I appealed in person. Successfully.

    Make sure you say you will be appealing in person. Get supporting statements from friends saying how limited you are and what you can't do.

    Now - on the day of the appeal itself - get someone to drop you off at the door of wherever it is you need to go (I was asked where had I parked? I explained my partner had dropped me off at the door and the security chappie helped me to the right area). Complete the appeal paperwork as if you are on the worst day ever. Make sure you have a chair to sit in with arms and it's a high one - ask if necessary.

    Good news about the blue badge - make sure you use it as much as possible. This is a sign that someone has assessed you as needing this so make sure you mention this with your DLA appeal.

    Keep on with the working - I also work and it does help to take my mind off my pain most day (not working today though unfortunately!). Keep socialising as much as you can; if you can't get to your friends can they come to you?

    Celebrate what you can do and ignore what you can't. Look forwards and not back. See problems as challenges that you need to overcome. By the very nature that you have these problems you will be a strong, determined, resourceful and courageous person - remember that.

    Ask at the hospital about the finance help with travelling. Also see if you are eligible for hospital transport - possibly not but worth asking. If you don't ask you don't find out!

    Keep going - don't let this beat you.

    Thank you for replying back

    I'd like to say the advice you've given has helped a lot and will keep this in mind for my appeal process. The blue badge is helping a lot already , I was assessed and literally a day or two later got a letter saying my application has been approved. I've read that the appeal process is quite lengthy , but worth it in the end if successful i hope. I rang DIAL yesterday and the lady goes don't even appeal against it , try applying again in 3 months. No help what so ever and was not what I wanted to hear. However will appeal and win this , am determined :)

    I used to have hospital transport , but I found that living quite a distance away from London, my legs used to ache with all the sitting down , which is why trains are much quicker, but deffo going to take a look at the low income scheme by the NHS.

    Work is a great way to get your mind off the pain , 100% and am always trying to join in on team nights out . So not doing too bad on the social aspect of things :)
