Waiting for a trbunal date re ESA

On the last leg of the ESA farce now. I had a letter to say that my appeal has to go to tribunal.
I have been retired with a state pension for 3 weeks now, so do not need to claim for the future, but I am still going to the tribunal on principal as I consider that I should have been paid WRAG in the last year.
They awarded me 0 points at the assessment, much to the surprise of my GP.
I have now had the results of my scans showing prolapsed discs in my lumbar spine and neck and degenerative changes in my spine. The Neurologist I saw could not see past my back pain (more severe than normal atm of the appointment) and said my uncoordinated walking was due to the pain. I couldn't get through to him that I walked like it even when the pain wasn't so bad.
My walking is slow and unsteady, and with pain if I don't stop for regular rests.
I use a stick all of the time outdoors and have days where my husband has to cook the meal or we have a takeaway.
Sitting at a dining chair up a table for more than 30 minutes means that I am in serious pain when I try to get up.
Even so I am not really that confident that they will pass me, although my husband tells me there is no way I could have worked over the past year.
He says I am still in denial over how much it affects me.
It really all makes me doubt myself and think that they may be right and I could have worked and that I am just being a sponger. :cry:
Oh well, just have to face the tribunal and hope that they believe me when I tell them how I am. The assessor certainly didn't (or didn't want to know).

    Same here, still waiting, had all the paperwork through just waiting for a date for the hearing..and then the circus will start again. Medical appeal tribunal, and so on until this farce is sorted out..aint letting these buggers get away with it..

    Good for you Pauline...its awful the stress they are causing people....the thing is they are picking on the wrong ones...we know that some are fit for work...but you cant put everyone in the same category, .good luck with it all x

    Does your scans not say it all, good for you fight them all the way, I personally don't feel guilty as I have worked full time for forty solid years I worked with my conditions until I couldn't do it anymore, I felt guilty at the start but not anymore, I am at the stage waiting to see if my appeal is going to tribunal, good luck Pauline keep us posted how you go...........Marie xx

    hi Pauline , done a few trbunal for incapacity for my son , one thing if you say about sitting more than 30 mins , if you done get up & more within that time they wont give you any points towards it , so move at some point .

    they are a lot better that the doctors doing the medicals so best of luck with it
