I`ve had my DLA decison overturned!

I reapplied for DLA last November, when things started to get worse mobility-wise. I have applied in the past, been turned down and didn`t appeal. But this time I thought `NO! I will not be made to feel like a fake`.
So I asked for it to be looked at again, still turned down. I asked for an appeal, still turned down. So I decided to go to Tribunal. Now this letter came in the weeks before my surgery, and I was feeling a bit low, but thought keep going!
I couldn`t attend the Tribunal as I am not fit to travel, but I got a letter today. I opened it nervously, and had to read it a few times to understand what it meant.
I have been awarded higher rate mobility back dated from November last year until November 2013. I have been declined care award.
I am so happy as this will really help us financially as my sick pay is due to drop next month. The funny thing is I have been told on the phone that I will need to reapply NOW for renewal in November as it takes 20 weeks!!
Mr NB says I should ask for them to backdate it to last time I applied, but I am not pushing my luck!!
I hope this gives some encouragement to anyone else in the process of applying etc.. Do not give up!!

Well done to you for appealing, a successful appeal & award should stand you in good stead when reapplying, well you would hope so anyway.
I do sometimes wonder if appeal-ers get a mark in their file somewhere, ie 'this person is liable to appeal & not be a pushover, maybe don't try it on with them'.. but that's just idle speculation. Certainly doesn't hurt to take them on, and as you say, everyone who doesn't appeal (or can't) is going to feel they've effectively agreed with an incorrect assessment of their illness or at worst feel they've been deemed a fake.

Well done to you for perservering but dont understand why they wont leave you be and why you have to re-apply now, to restart the whole stress period. But this will give you a bit of confidence and the tenacity to follow it through...

Thankyou everybody for your support.
I have had a few low days with pain and feeling alone etc.. so this has brightened my spirits a little! I have just spoken to the Tax credit people as our award for that is also up for renewal. I should be due something from them too, but it has to go off to another office in cyber space to be verified!!
If I knew my DLA was for longer without being reviewed i would look at a motability car as I think I would manage an automatic easier when I go back to driving and maybe a slightly higher car. But with the renewal for the DLA hanging over me i don`t think it is worth the worry of getting a car then losing it perhaps.
Not sure if anyone knows of anything else my award entitles me to? I already have a Blue Badge.

Hi NB, I am over the moon for you, it shows if you keep at them you get there in the end although it is disgusting that genuine people have to go through all the stress that they put us through, you should be able to get free road tax I think(memory) as you are getting the high rate for mobility it is worth enquiring, good luck when you re-apply................Marie xxSmile a while and while you smile

I have still to wait for a letter from DWP with more details of my award , and of course my renewal pack :roll:
It will really help us financially as my sick pay will drop next month and I don`t think I will be able to go back to work before then. It may help me if I find that I need to drop my hours too.

I'm so glad you managed to battle on even wen you weren't feeling well. It's so important not to cave under their pressure so good for you
I have PsA & OA n was awarded highest mobility for 5yrs on my 1st application n I've done my renewal & have the same again tho my care needs have changed massively in the past few years so I fought for a higher rate than low. After requesting my application was looked at again I was awarded the same again but indefinitely, I disagreed so asked them to look again. I found out they'd made their decision without my gp report so I got a copy, I also obtained reports from my Dermatologist & Rheumatologist, I sent it all off with a cover letter & I'm now in receipt of highest rate care & mobility!! Another case that shows fighting is definitely worth it!!
I don't understand y I'm getting awarded 5 years at a time & uve only received 1 year tho??I would suggest getting copies of a medical report from any consultants/Doctors that you see to send in with your renewal. I'd also ask them if ure ever likely to improve coz if you aren't it would be REALLY helpful if they'd include that information for you, it could mean ul get a longer award!!

Congratulations - Im so pleased for you.
You can get free road tax & I think reduced council tax if you inform them, disability badge to help with parking is automatic with high rate award.
I know it doesnt make up for all the pain & distress , but anything that helps makes life easier is worth it , both physically & financially. I totally agree we shouldnt be made to feel like criminals , the system is so unfair as it causes so much stress on top of an already painful condition.
