I am so happy for you, Iris. That is such tremenduously great news.
It is very unfortunate that things did not go smoothly for you as they most definitely should have done, along with so many other people, but with your grit and determination to receive fairness, you will now receive it.
MP's can come up trumps then?
Now you will be able to concentrate so much more on getting yourself back to normal.

Thank you Barabara, DD, Ironic, Dippy, Salamander, Toni, Elaine & Sol, Elna and Clair.
It was nice to share some good news for a change
No guarantees of a quick or positive outcome but it feels so good to have someone else take this on for me.
It was this MP's private member's Bill that kick started the whole Disability Discrimination Act so he is always very approachable in relation to disability issues and has helped me in the past
thanks again everyone, I'll let you know if/ when I hear anything.

The MP's PA emailed me yesterday to say the letters have gone off 'special messenger' whatever that is. :!: so the clock starts ticking as soon as the local dwp office receive it...they have 48hrs to reconsider the decision...and it has to be reconsidered by a different dwp officer.
I'm not expecting that they will change their decision... that would be too easy! and we all know that we have to fight tooth and nail through the long process of appeal to stand a chance of overturning it!
I guess dwp'll write back to my MP as he's now representing me. I'll let you know as soon as I hear anything....

We will all have our fingers crossed for you, Iris. Your MP sounds great & it's really interesting to hear about the members bill regarding the DDA. So many companies, inc my last, seem to duck under the net on this issue however big they are & get away with it.
Sorry, I can't answer your post script: the only person I know in the support group had an awful bike accident a few years ago & is bedridden but I also know that even he has had to fight tooth & nail for his entitlement! Ridiculous isn't it?

do you know... I'm really surprised there hasn't been a bigger outcry from the public about this fiasco of a 'benefits' system .... especially in relation to ESA and DLA :?
Nor have I seen a demonstration by any group .... there are 10million people in the UK suffering from arthritis and 12,000 children......imagine what would happen if we all took to the streets with banners!... or every adult and parent of a child with arthritis lobbied their MPs?... that would send a clear message to the government.
It would be nice to think that the current WCA consultation will lead to restructuring and a fairer system of assessment..... we'll see..

Hello there, just another quickie question!
Iris, do you know whether or when they review your ESA claim once it has been accepted? Is it every six months or yearly or do they do it at all? Yet another question that is not explained on their leaflets!
Maybe anyone else might know answer to this also.

Hi Pennie!
You can be called for further ESA work capability assessment at any time.
The reassessment will 'normally' be based on how long the medical assessor at your first/ most recent assessment decided you were likely to have a limited capability for work? For example, if it was recorded that an improvement could be expected within a year, the WCA will in all probability be repeated around that period of time.
Not a very precise answer Pennie... a bit like the whole process!
Suggest you phone DWP and ask if a date/ timescale for WCA re-assessment was recorded by the Assessor.... or you could ask the Pathways Adviser at your next interview.

My Neice went straight into the support group. She has a degenerative disease of the brain, inherited from her mother. She worked until her employer could'nt cope with the safety issues around her case. She is much worse now, she can't eat unless the food is in special containers, she is in a wheel chair, she can't go outside the house unless someone is with her, even in her electric chair, as she could loose control of it. She can't write anymore and her vision is effected although she can still read. Mentally, she is not always able to remember or say what she means.
I filled the form in for her and wondered if they would try and send for her. They didn't, they just got her social worker to visit and tell her not to worry she'd go into the special support group. Fantastic, but I would have liked to fight that!!! Don't feel sorry for her, shes a happy girl who still enjoys her disabled swimming on a Sunday and has so many friends, I can't keep track of them. Shes married happily, fills the house with friends, knows all the local gossip and is never happier than passing on stories, I get phone calls at all times to tell my that someone is leaving someone else !!!!!!!!!!!!!!0 -

Pennie ... there was another thread about the pathways interview, and I can't remember which one it was, but basically .... cutting a long story short ........ Iris hobbled to the inconveniently situated office for an early morning appointment on the Monday, having just had her knees aspirated and injected with steroids the previous friday, to find the office CLOSED and locked :shock:
turns out her letter should have given a different venue, but someone 'forgot' to change the letter :roll: :roll: :roll: :roll:
After 'words' with them over the phone Iris has her next date for in interview by phone .... so a small victory for her but she didn't need all that hassle :x :x :x0 -

That was terrible - I think I am really lucky with my advisor & job centre by the sounds of it. My first appointment was the week before my op & although the next one was due a month later he cancelled it for three months. He is really nice & understanding - he is putting me in touch now with a support centre who he said can help me find something suitable.
I'm still dubious that anyone would want to take me on but trying to stay positive.

and having 'reconsidered' their original decision...
they've decided NOT to change it. :roll: :shock: :?
SO, it looks like next stop is an Appeals Tribunal ...

ps...BTW... I have my first 'Pathways' Interview since being placed in the ' Work Related Activity Group'..on Monday (by telephone).
I wonder if having both knees aspirated and injected with steroids again will count as ' evidence' of getting myself motivated to get back to the workplace. :x :x0
