Hi Iris,
Well I juts think they are morons actually... maybe not quite morons but that will have to do! I am really cross they are doing this to you and its just wrong!
You got a hug bucket? Well you now got one or two depending and cyber ones are better than nothing so ((((((((((((((((((( ))))))))))))))))))) love Cris xxx0 -
What a bunch of twerps. Words fail me and that is a rare thing, as you all know! dorcas, I am so very sorry. You have to go to tribunal, a real pain I know but what they are doing to you is stupid beyond all belief. Twerps. DDHave you got the despatches? No, I always walk like this. Eddie Braben0

Thanks Cris and Damsel
..they are twerps!
Dictionary definition ... A person regarded as insignificant and contemptible.
Problem is that they are unfortunately making decisions that impact on the rest of us. :x

Oh Iris, how ridiculous. The fact that you took early retirement from a job you loved on health grounds ... should explain it all. What is the point of early retirement if you are then put in the "work related activity group." What does that mean anyway? It sounds a bit like what S does at school "work related learning" which is akin to work experience...
Well, looks like you are through to the next battle stage! So much for a quiet life, a bit of voluntary work and concentrating on your own needs for once.
Have you informed your helpful MP? Is he willing to support you in the next phase?
SpeedyI have had OA since mid twenties. It affects my hips and knees. I had a THR on the left aged 30 and now have a resurface-replacement on the right - done May 2010.0 -
I'm sorry to hear that Iris. They are not twerps, they are b*******, deliberately targeting the sick to reduce the welfare bill. Do they get paid every time they put someone in the work related group I wonder?
Fight them Iris! We are behind you hun.

Hi speedy and Sal
I sent my MP an e-mail yesterday to let him know that the 'reconsideration' had come to nought! I'm pretty sure he will want to help with the Appeal.
It's a wonder he's not fed up with me as I e-mailed him (and others) about the Spending Cuts Review a few days ago and he's already written back to me about that.
sorry Sal  I maybe should have started a new thread rather than adding to my 'old' one..
The letter from DWP did not say why/ on what basis they had reached that decision... a bog standard and badly photocopied letter it was!... but it did say that I could phone for more information and appeal the decision.
I'll phone on Monday or Tuesday....
thanks again for your support.!

Hi Iris, I modified my original post to you - made it stronger as felt it didn't reflect my anger at what is happening to you. I feel so angry that everyone is being treated in this way. I don't what is going to happen to people.
Glad you've got your MP on board. It does make a difference if you can get someone to advocate for you.

Hi
Oh goodness - how frustrating for you. You did well not to resort to sarcasm and not to show your anger. What a bunch of nupties. I hope it gets sorted out and by the sounds of it they've picked on the wrong person!! Stick to your guns.
I was once so incensed by behaviour by a previous neighbour that I cursed the ground they walked on. Next week the very large tree in their garden fell onto their house!!! I felt really guilty for ages!!
We moved away from the area and thank goodness the neighbours are generally ok!!!
Take care
Sharmaine
Xdorcas wrote:Hi everyone,
It's almost three weeks since I had the ATOS medical assessment but finally received the decision letter from dwp in the post today.
I wish it were better news.
I've been assessed as having 'potential capability' for work and placed in the 'Work Related Activity Group' I have to attend a 'Personal Adviser' and show that I am taking 'reasonable steps' to manage my condition and so move back into the workplace.
So there we have it..... it doesn't matter what your medical history or mobility is, that you're post op and awaiting more surgery, attending various consultants, starting new treatments ..and..that you had to take early retirement from a job you enjoyed (and miss) because of the impact of arther.
Someone higher up the food chain ...and obviously brighter than me has decided that I may be able to work.
I am fizzing mad
The letter states that if you want to know more about the decision or think it's wrong to phone them.... so of course I did. I explained calmly and politely that I thought the decision was wrong and wanted an explanation. The dwp employee was helpful and said that she would e-mail the medical section and request they contact me.
Amazingly I was called about 5 minutes later; this person said that you have to be in exceptional circumstances, cancer, chemotherapy, or be deemed physically/ mentally unable to work, to be placed in the support group, but that I could appeal the decision. I pointed out that she had missed out an important stage in the process ...that I could ask for 'reconsideration of the decision' before having to go down the route of appealing.
I'm afraid she then gave me misleading information saying that the reconsideration was part of the appeal . When challenged that it was a separate process she agreed but said that it would save me time to go straight to appeal. After digging my heels in and a little more prompting by me about time-scales I was finally advised that if I wrote in and ask for 'reconsideration' attaching any medical information/ any updates that this will be considered and a response regarding upholding or changing their decision sent within 48hrs of my letter being received.
Oh.. and the leaflet they sent me was for appealing Jobseekers not ESA decisions... so I told her that too.... politely, calmly.
Then I came off the phone and screamed (inwardly so as not to frighten the dogs) :x :x :x :x :x that's better.
I am e-mailing both my MP and MSP and making a start on my letter.
Anyone volunteering to write it for me? as I still can't hold a pen; but that doesn't matter to dwp either.

Hi Iris
so sorry to hear they turned you down - you have to fight them :!:
i am sending loads hugs and support - you have always been there for me and i hope i will be there for you - in mind but not in body :!:
one question - with all the changes coming in - the ones who have had a decision now - will they have to go through all the crap again :?:
let us know how you get on with your fight - i will be in your pocket jumping and shouting - well not shouting but fighting for you :!:
hugs again

Hi Sal, Sharmaine and Louise
I am really really thankful for your words of support
Sal.. this whole ESA process with the seriously flawed ATOS medical assessments at the heart of it is appalling and I share your anger!
Sharmaine.. Wow  that was a seriously spooky result to your curse!!! I might resort to that before long.!
Louise... I love the idea that when the time comes you would be jumping about in my pocket.... and trying not to shout. I'll let you know when I need you!
... about the Spending Cuts Review and ESA. I have e- mailed my MP and written to David Cameron and Nick Clegg! I also wrote to the Shadow Secretary for Work & Pensions when I heard him on the Andrew Marr show last Sunday supporting the coalitions ESA time restrictions. I was speechless (almost!) and had to put pen to paper.
I also heard Sally Wassel (finance journalist and broadcaster) speak on breakfast tv last weekend and responded on her website to her forum post about the review......and also posted a question to her Panel of Experts about the implications of the Review on the genuine disabled claimants and what would happen after the 12mths time-scale.
Sally Wassel has just posted an article about the Cuts and impact on ESA and IB (Incapacity Benefit) on her website... it is really worth a read.

Hi Iris
 Sorry I totally missed this thread when it originated and have only just caught up with all this as it reappeared. Am I reading this right that they are suggesting you, Wally and the poorly knees are fit for work?? Nah I must have got that wrong!!!
Perhaps I should go back and read it through again. Do hope you continue to keep fighting Iris, this is too ridiculous for words!!!! Sending you some additional stamina, fortitude and hugs. (((( ))))
