Lost my ESA tribunal

Hi
Just as I thought nasty nasty lot they are
What really upsets me are the fact other people are failing and only have the ESA benefit as their only income
I'm lucky my claim was only from end of sept last year till beginning of march this year when my ill health retirement pension started
So now its time to get on with my life and b****cks to them all
I want to thank everyone for their support and hope others have better luck than I had

sorry to hear you lost your appeal. I think you do right to put it behind you and get on with your life, (if you can afford to due to your pension etc)
It must have been a very stressful experience.
I got my letter from payroll telling me my ssp runs out soon and can apply for ESA. Not sure what I am doing about that, as I will get the Occ Health assessment tomorrow.
I hope you can relax and not be too upset about it all ((( ))))

Whoa, sorry Maria. This brings back awful memories for me. I lost mine too, well, the equivalent of your UK system here in Canada. From what I've read the systems and biases sound similar. I was totally humiliated by the whole process and at the time becoming very ill. I guess it's two years ago now. The tribunal lawyer made several very unsavory remarks off tape and I wondered why I had bothered in the first place. I had thought they were there to help people. Boy, was I naive.
These systems really need to start being informed by disabled, ill people, not just doctor's chart notes which they happily discount anyway!
I think I avoided your thread on purpose I'm so cynical I didn't think I could offer anything to you. Sorry your result was in the negative. I went into a very large, long flare after mine and I made it worse by stewing and stewing over the stupidity of it all. Hoping you are wiser than me
This reminds me I still need to go have my "chat" with my local politician regarding the whole process. I can still get a good rant going with little provocation!

Maria, I'm sorry it didn't go the way you would have liked, or indeed deserved. I'm taking a few months off work due to being in so much pain and everything that comes with it, but come January I am going to have to seriously think about my options. I am dreading having to go down that road. Before I went self employed I had to go onto JSA, and that was humiliating enough. I hobbled in on my walking stick for my ritual humiliation, and was told to apply for a job in WH S****s...job description stated applicants must be physically fit as job involved pulling and pushing heavy trolleys full of books and magazines. I just looked at the advisor, and then at my stick, and then back at her. And I know from what I've read on here that it is a million times harder to get ESA etc. The staff involved have no idea do they?

I'm really sorry Maria. If ure entitled to it then I'd appeal again. It's an absolute joke wot this Country is doing to many sick & disabled!! I go thru my MP for everything.

Grrr, so sorry to hear this Maria I downloaded the info on ESA the other day, but pretty sure I don't have a hope in light of your situation. None of us want to be on benefits, but what are we supposed to live on?? Hugs xToots x0

I'm so sorry Maria, what a bunch of a-holes hey! It's your decision if you want to knock it on the head or carry on to another tribunal. If your sure you will have enough money with your pension to live on. I think the whole way they decide who gets it and who doesn't is wrong. They seem to be turning down the wrong people from what I've been seeing on here and it's taken away any positive vibes I had on me getting both! Oh well my fate will be known soon.0

I can't see any point in taking it further as it was only for 6 months I'm just waiting now to see if they want their money back! From 10/1/13 which is about 8 weeks and a cost of £490 ish if so they can have it back at a £1.00 a month! Or might even give em it all back in £ coins which ever is the most difficult for them it took em 3 months to begin with before I got my 1st payment any way :x
Luckily my husband put the money aside as he didn't trust them to start with!
I get so mad as I have worked for 30 yrs and never claimed a penny neither has my husband and he's work for 33 years never had a penny for our children other than child allowance we did claim family tax credit and only got it for a few months before they raised the boundaries to just above our joint income :x
We are paying for all the low life scumbags that won't work don't want to work and get every benefit going feel like putting them all on an island and leaving them to fester oops didn't mean to say that was just thinking it and it came out
So after 4yrs of hell at work with written warning failed appeals nasty evil ward managers nasty HR dept nasty DWP and nasty Atos all with tons and tons of evidence etc I'm leaving it all behind me and I'm going to live my life as a retired lady and enjoy myself now that made me sound ancient I'm only 50 :roll:

Maria you have taken the words out of my mouth...I get so mad when I SEE THESE PEOPLE ON THE STREETS DOING WHAT THEY DO APART FROM WORK..oops sorry didn't mean to shout...that is how annoyed I am for you, but yes don't let them take another min form you...enjoy what you have and think of these miserable people you mentioned going home to there miserable life's..sure they cant be happy...xxLove

OH maria what can i say just read your post after coming out of hospital today all i can say is there no way you can appeal or would all the extra stress set you of. if it would upset your arther really bad then carry on with your life & close the book for now.BUT NEVER SAY NEVER as it gets worse then try again because it will do. sorry for shouting but so mad for you half these people that make these assessments do not know just how much pain we can be in destiny0

Thank you all for your support, compassion and understanding over this stressful time
My next step is to sort out HMS taxes as they are charging me 20% tax when my pension is way way below and they are taking £200.00 a month off me when I should not be paying any! Grrr
Keep strong out there and don't let the b****ds get you down

Your right they make us feel like the crooks when their are people out there who refuse to work and claim off the state and the day their money goes into the bank they take it out and spend the day in the pub!! I've seen them all queue at the nearest cashpoint to the pub take their money out and disappear in the pub!! And us the really sick ones do as we are told and fill in these never ending forms and be put through constant checks and end up being turned down for benefits that we need. It's like being ostracised for being disabled. Sorry for the rant but I think it's so wrong!0

AGREE! sorry Maria about this its dreadful - Its like they don't believe a word we say. I didn't realise you can have your assessment recorded is this audio or video recorded.
I was in the car with my wife the other day and we drove past the local medical centre and saw a person with a white coat on going to their car park and getting into their brand new 63 plate shiny Mercedes ok for some.
If you feel upto it I would appeal again and go to your MP about it all - Whatever you decide, good luck.0 -

The fight in me has gone and I just want to get my life back to normal well as normal as can be
And at least I have my little NHS pension so I'm not destitute
I feel for other people in the same situation that have nothing financially behind them
And don't get my started on the benefit cheats who have ruined it for the truly sick and disabled

My history was the same Maria. I just couldn't muster the strength for a second appeal so muddle along on the meager disability offered (and very glad it's there too!). It was a relief to just give up in my case. I was not proud of that, though. What they do is so wrong-headed!
It's all geared to ferreting out cheats at the expense of legitimate claimers. I can't do anything on disability without engaging an advocate who is familiar with all the rules and legislation. The system here sounds so similar to yours in the UK, but maybe we are slightly better off.
Yes, the bad apples should really know who it is that's suffering for their cheating efforts.0 -

First of all let me say I am so sorry you lost your tribunal
Secondly Yep you are right they really are a nasty bunch they really do come after you with all guns blazing leaving no stone of your personal life unturned
Trying to trip you up and twist everything you say
I have said this before and I must reiterate it to anyone having to attend one of these tribunals You must repeat must know your stuff and before you attend get help from the CAB, Make sure you have notes that you can refer back to Do not let them try to rush you and if you feel that they are doing so tell them and ask for a moment
Also take with you someone for support I have to say you feel very vulnerable and having someone with really does help
I won my case on appeal and have to say if you are not satisfied you have everything to win by doing so

To be honest I can't be bothered any more plus you can only get ESA for a year and 27/9/13 is when mines up
They haven't asked for the money back and I only claimed until my NHS ill health pension started in march
If I eventually need to apply for PIP I know now not to trust them Nd get it recorded
