I have my tribunal date on friday...I am in no doubt I will fail as they thought I was fit for work before during and after my knee replacement in October 2012.....I will however go with all my paperwork, point out their faults, the way they interpret things (when I say I cannot do something its not a refusal it means I cannot) and how the first healthcare professional? thought angioedema was to do with cardio problems! Im going buy myself cos I don't want my dad to have the stress of attending with me...Its at 3.30 in the afternoon on a friday so they will stop my money before the end of the day...It does puzzle me all these new things government propose for jobseekers which I will be on soon....Where do they think all these jobs we can take up are or apprenticeships, supposedly manufacturing is up - where? Also people are made to work longer so jobs younger people could take are not available because of the person working till nearly age 70? David Cameron has no idea of everyday life as so demonstrated with his bread answer last week...

Hi Elaine,
I just wanted to say good luck with the tribunal. It's soul destroying being told that you are fit for work when you are not. I'm appealing against the decision to stop my ESA and waiting for a date for a tribunal so I can empathise with your situation. I'm with you about Cameron. Where does he think all these jobs we're supposed to be able to do are????

The government should have tackled the benefits culture decades ago but the fact of the matter is that the blokes I see living in Ladbrokes all day all week, never having worked a day in their life will never ever change, that's who should be targeted. ATOS are just awful the healthcare so called professionals are often not experts in anything, besides even if you look up my TKR last year...Well I was 44, fit and healthy, supposed to come out after 3-4 days, well I was in 8 days, had blood transfusion, deformity corrected, bad reaction to blood transfusion and a bend upon discharge of less than 70%....The whole point being not everyone matches the ideal...

Just go in there do you best that's all you can do
I do feel they make their mind up before you go in!
I was still using my crutch when I went in and still failed

Hi Elaine, good luck for Friday, it is soul destroying when you obviously are in no state to work but some jobs worth refuses to listen to you or look at your forms properly, it's like they have already made there decision before they have even seen you. I also agree with you and others where does posh boy Cameron think all these jobs are? There are thousands of people still unemployed and can't find jobs so what chance does a sick disabled person have trying to find work? Why take real disabled people off their benefits who have loads of prove that they have a real illness and are unfit to work and let half of these dole dossers who's only disability is laziness to find work let them keep their benefit! Sorry got on my soap box again!! Hope you get a break on Friday and change their minds. Will have my bent fingers crossed for you.0

My hubby had his 1st medical this year, his was a home one tho. It's so degrading. I couldn't believe how they tried to lie about his medical problems, I'd heard it happened & believed it but to see & hear it in person was astonishing!!!
I hope you get a positive outcome.
I think the benefits should be linked somehow. If you get DLA/PIP & it's a 3yr award, for instance, then it should be the same for ESA etc It would save on so much paperwork & double medicals but mostly it would cut down our stress massively!! If people aren't on DLA/PIP for instance then, and only then, should they be assessed annually!! Well that's how I'd do it.

I know it wont and that they do indeed make up their mind as soon as you walk into the examining room and the magistrates court? I e.mean I have never in my life been in a magistrates court, what a waste of time...

Cameron has no idea, neither has IDS, Clegg, Vince Cable and numerous members of our governmet who are all public schoolboys who have no idea what its like to struggle on a day to day basis....I won't get a break on friday but if I get my say I won't let myself down.

Well Im quite sure they will have a few rabbits to pull out of the hat on friday but if that's all they can resolve to it shows how manipulative they are...Im sorry to hera about your husband too..I agree with yur proposal for award of benefits, why can't someone normal stand up for us and all the poor remploy people who are reduced to voluntary work, no good for the soul...

Mine was on a Saturday
The judge wanted to get home so I had to wait till the Tuesday to find out I'd failed
I should have said no I want to know now she said they were busy if busy meant an empty room and only 3 people that day I was the last! Then she was busy! Grrr

It wont be today as I won't get home till well after 5.30pm as it's half an hour away from where I live...Plus we all know the outcome but it will be an education to say the least....Arguing is something I am looking forward to!
