    I always knew the outcome would be no but 0 points was a shock - how can someone who cannot perform the exercises she asked me to do get 0 points....? Beggards belief....I have to wait for the blasted first form to come then request the full medical report...Will note down their names and times...

    ote="villier"]Hi Elaine at last you know the outcome, I would certainly take the forms to CAB they actually filled them in for me which was good as I find it hard holding a pen and my writing is terrible, as the chap at the job centre said go for it as it will bide you time and maybe by the time the tribunal comes up you will be ready to get a job, the report you get through will be a shortened version you will have to phone the DWP for the full face to face report, I suggest phoning as I wrote to them as I never got an answer it took two phone calls before I got it, good luck know how you feel...............Marie x[/quote]

    Thing is with phone calls its your word against them getting it written in black and white and proof of their incompetence.
    You need to make sure you have their name time you rang and how long you were on the phone for even ask for written conformation as sad to say they can't be trusted!

    I was just checking your thread...on on earth they can award you no points is beyond me, you carry on appealing ....they do seem to be trying this with everyone...Good Luck

    Doing what I can thanks Maria..Applying for more jobs all the while but no letter yet...I have to accept I will lose this week and maybe part of next week cos they are taking their time sending letter....

    By reading the last page of your thread I am assuming that it did not turn out favorably? I honestly am sorry to hear that.

    It makes me so mad, stress makes arthritis worse don't you think? ...

    I have a family friend who suffers immensely with epilepsy and fits several times a night - they denied him his benefit but he took them to a tribunal and won! .... don't give up!!!... His specialist wrote to them too I think. it must be a numbers thing that they only allow so many through and hope some people won't want the trouble appealing.

    I do hope everything works out ok for you.

    0 points and they are dragging their heels sending correspondence but I am seeing CAB next thrusday....It means no money for about 2 weeks how do they think we survive....??

    Elaine please make them aware that you are appealing the decision and you want to be kept on the ESA assessment rate until your appeal is heard. Send this in writing recorded delivery so that you have proof that they have received this. You can send evidence, anything that helps your case right up until the appeal date so please don't lose any money by delaying letting them know you are appealling. As I said, you don't have to make your case now, you have right up until your appeal date which could be months. If you want representation from CAB you can add them to your appeal at a later date.

    Yes thanks am appealing this as its not right but I know I am a matter of thousands this is happening to...Seeing cab next week so everthhing will go then recorded....No excuses..

    I don't know if you are on facebook but I have just come across a page called "the people vs the government dwp and atos" ..... maybe they might be able to help? There are a few links on their page.

    I hope you get on ok at the CAB. I have been there before and found them useful.

    I've heard nothing from my appeal I do believe they won't bother to reply as they know I won't be claiming it for much longer!
    Think I might need CAB again to see if there is anything I can claim for

    You may have a point there...My dad gets attendance allowance and he is 81 has had it since his hip in 2007 and he has never informed them he is better or anything but cos of his age they think "well we can hardly put him out to work, he has paid his stamp"...So he never gets hassled...How I wish they would use the same rules when recouperating from an operation or someone has a condition that has no prospect of ever getting any better...I call it COMMON SENSE, do they know what that is?

    I had yet another brown envelope asking what my ill health retirement nosey b*****s
    Was going to send letter back saying its got naff all to do with you! But Hubby wasn't Impressed I said I'm not claiming for anything just want to keep the ESA entitlement I've been given!
    I'd love to meet this Rita woman she's totally incompetent but she appears to have been promoted according to her job title :roll:
    Not sent my tribunal info off yet but there seems to be no rush as surprise surprise as the have an increased number of tribunals :roll:
    I'm hoping I get my foot surgery before then and walk in all potted up and on crutches :lol:
